A PUD agreement shall be approved by the City Council and signed by both parties prior to the issuance of building permits for any building within the project area. 2. Staff approval of a landscape plan meeting the city ordinance requirements is required. 3. Lift stations associated with public services shall be public. 4. All watermains shall be looped. Background/Discussion The applicant has proposed a multi-family residential development south of Kliever Lake Fields. The application includes a Zone Change (ZC 22-05) to Planned Unit Development (PUD) and a preliminary plat (P 22-10) to create a detached townhome development consisting of 43 lots. Comprehensive Plan The Comprehensive Plan guides the property as Traditional Single- Family Residential which predominately consists of single-family detached homes occupying moderately sized lots. This land use, while predominately single-family detached, should accommodate single-family attached and townhomes. Site Plan The 43 lots are laid out along two through streets and one cul-de-sac with access from Fillmore Street to the east and Hoover Street to the south. Each home will have driveway access to public streets. Updated: August 2020 There is a strip of wetland traversing east to west near the middle of the north half of the parcel. The applicant is proposing minor impacts to the wetland. This wetland complex and the overhead power lines will be located within outlots and will not be developed in the future. Engineering and Utilities The applicant is proposing a private lift station for the lots in Block 4. Lift stations associated with public services shall be public and all watermains shall be looped. Landscaping The proposal does not include a landscape plan, but staff review, and approval of a landscape plan meeting the city ordinance requirements, is required. Applicable Regulations Conditional Use Permit/PUD The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. The residential use will not detrimentally affect the use and enjoyment of adjacent properties. 2. Will be consistent with the Comprehensive Plan. The property is guided for Traditional Single-Family Residential where residential uses are permitted. The use will be consistent with the Comprehensive Plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. The only undeveloped property is one similarity size and shaped directly to the west of the subject parcel. The project will not impede normal development of the area. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares.
