Park dedication shall be satisfied per the Parks and Recreation Commission recommendation and City Council approval. Background/Discussion The subject property is 17.56 acres in size and located west of Fillmore th Street at the 178 Avenue alignment and is zoned Single Family Residential (R1-c). The applicant is also requesting a Zone Change (ZC 22-05) and a Conditional Use Permit (CU 22-15) to develop a detached townhome development. The proposed subdivision will consist of 43 lots and three outlots. The outlots are encumbered by overhead power lines and wetlands and will not be developed in the future. The subdivision will connect to existing Hoover Street to the south and provide a new east/west street through the development to the 20- acre parcel to the west. The plan is to have a connection through the subject parcel and the adjacent 20-acre parcel to the existing development (Eagles Marsh) to the west, from Fillmore Street to Johnson Street. Sidewalks are proposed on all streets. Parks and Recreation Park dedication is eligible for the 43 lots at the low-density residential rate. The exact amount will be determined at the time of recording. The Parks and Recreation Commission is expected to make a recommendation on park dedication at their July 13, 2022, regular meeting. Updated: August 2020 Applicable Regulations Preliminary Plat City ordinance section 30-375 outlines the required findings for approval of a Preliminary Plat. 1. The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the zoning regulations and this article. The property when rezoned to Planned Unit Development and meeting all dimensional requirements will be consistent with all zoning regulations. 2. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. The property when rezoned to Planned Unit Development will be guided for residential, and the subdivision is consistent with all applicable plans. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required in this article.
