7.2 SR 07-05-2022it ci Elk* River Request for Action To Item Number Mayor and City Council 7.2 Agenda Section Meeting Date Prepared by Public Hearings July 5, 2022 Zack Carlton, Community Development Director Item Description Reviewed by Plat: Franklin Properties Addition Chris Leeseber , Senior Planner Reviewed by Cal Portner, City Administrator Action Requested Adopt, by motion, a resolution approving the Plat of Franklin Properties Addition with the condition that the variance approving the substandard lot size shall be recorded prior to the plat. Background/Discussion The applicant is requesting approval of a plat to create a buildable lot in support of an advertising sign (billboard). The project area includes one lot, currently platted as Oudot A of The Crossroads Second Addition, which was created as part of the extension of Zane Avenue north to what is currently the Elk River Lodge apartment building. The lot is located between Zane Avenue and Highway 10 and is significantly below minimum lot size standards. To support the platting of the parcel, the applicant has received approval of variance allowing the substandard oudot to be platted as a buildable lot in support of the billboard proposal. The lot is approximately 3,500 SF in size, severely limiting development potential for much beyond a billboard. The variance approval included a limit on sign height to reduce conflicts with adjacent land uses and the applicant has not requested a digital billboard. Currently, the applicant plans to install a 30-foot tall (the same height as the existing Saxon Sign) two -tiered billboard. Applicable Regulations City ordinance section 30-375 outlines the required findings for approval. 9. The proposed subdivision is consistent n ith the honing regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the honing regulations and this article. The Board of Adjustments approved a lot size variance allowing the parcel to be platted as a substandard lot. The request did not include any additional deviations and any development of the site will need to comply with The Elk River Vision P I I E I E U I Y A welcoming community with revolutionary and spirited resourcefulness, exceptional [NATURE] service, and community engagement that encourages and inspires prosperity. Updated. August 2020 other standards outlined in the ordinance. This includes setbacks and permitting standards. The current billboard proposal meets those standards along with the included variance condition limiting overall sign height. 2. The proposed subdivision is consistent with all applicable general and speciali.Zed city, county, and regional plans, including but not limited to, the city's comprehensive development plan. The Comprehensive Plan guides the small lot for Highway Business uses and additional planning documents do not conflict with the proposed subdivision nor the proposed use. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated. The physical characteristics are suitable for the type and density of development and uses contemplated. 4. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required in this article. The subdivision will include infrastructure to meet city requirements. The proposed billboard use will not require sewer/water nor will it place an undue burden on city services. 5. The proposed subdivision mill not cause substantial environmental damage. Although there will be site grading, there is an existing sign on the property and the proposed billboard will have similar impacts to the site. 6. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. 7.
