Request by the City of Elk River to Amend the Resolution of the
Final Plat of Windsor Meadows
Staff was given direction to draft a resolution amending the final plat for Windsor Meadows
to allow the barriers to be removed after the first lift of blacktop has been laid and for staff
to notify the property owners in the Windsor Meadows development and the Windsor Park
1 S\ 2nd, and 3rd Additions.
Planning Department Mission: the orderly development of a livable and sustainable Elk River community.

CITY OF ELK RIVER
A RESOLUTION AMENDING FINAL PLAT APPROVAL FOR:
Windsor Meadows
Case No. P 04-18
WHEREAS, application has been made for final plat approval, pursuant to Section
1008.08 (l)(c) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the application for preliminary plat approval has been referred to the
Planning Commission which has given its advice and recommendation to the City Council;
and
WHEREAS, a preliminary plat of the Property was approved by the City Council on
August 16, 2004; and
WHEREAS, the proposed final plat 1S consistent with the preliminary plat as
approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set forth
by the City Council in its approval of the preliminary plat of the Property; and
WHEREAS, the situation that required final plat condition #18, which reads, The
access (21 ~h Avenue) from Windsor Park 1'1 & 2"d Additions shall be temporarilY blocked until the final
lift of bituminous is installed and/ or 50% of the homes are occuPied, is no longer needed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. That condition #18 is eliminated from the original resolution for Final Plateapproval for Windsor Meadows.
The foregoing resolution was introduced by Council Member and
duly seconded by Council Member . The following voted in favor
of the Resolution:

Re: Windsor Meadows Barrier
Acting Mayor and Council Members,
These are conversations I have had with residents in regards to amending the Final Plat
for Windsor Meadows that will be unable to attend the October 17,2005 City Council
Meeting.
Tom and Judy Duenow, 21199 Joplin Street, indicated that they were frustrated that the
initial agreement of the barrier was never really honored. The barriers are portable and
are always moved. They stated that speed is the issue and not as much about the traffic
itself. They questioned if any traffic controlling devices could be put in place to help
reduce the speeding of construction traffic.
Brad Erickson, 13523 212th Avenue, also indicated that he was frustrated that the initial
agreement of the barrier was never really honored. He stated that the residential traffic is
not the problem, but that it is the construction traffic. Their development has been
dealing with construction traffic for the past three years. He is also frustrated with the
system and with being notified so late of the meeting. (The notices were mailed on
October 11,2005)
