Approve, by motion, the Conditional Use Permit (CUP) establishing a residential Planned Unit Development (PUD) with the following conditions to satisfy the standards set forth in Section 30-654: 1. A PUD agreement shall be approved by the City Council and signed by both parties prior to the issuance of building permits for any building within the project area. 2. All garages shall be at least 528 square feet in size. 3. Driveways shall be no wider than 18 feet at the right-of-way. 4. The PUD agreement shall include a parking plan, floor plans for all unit types, a final landscaping plan, and guidelines for building colors, facades, and materials. 5. Staff approval of all plans and drawings, including landscape, stormwater, grading, and all civil plans. 6. The zone change must be approved and recorded prior to the CUP being recorded. Approve, by motion, the Preliminary Plat for The Villas at Fillmore. Adopt, by motion, a resolution approving the final plat of The Villas at Fillmore with the following conditions: 1. A Development Agreement must be signed by the city and developer prior to releasing the final plat for recording. 2. The PUD agreement must be approved and recorded prior to releasing the final plat for recording. 3. Park Dedication shall be paid in the amount required by the city when the final plat is released for recording (currently $1,425.93/lot). 4. Water Availability Charge shall be paid in the amount required by the city when the final plat is released for recording (currently $390/plumbing unit). Upon completion of all improvements and acceptance by the city, a security or warranty in a form acceptable to the Public Works Director must be secured. The Development Plan shall be approved by the Public Works Director prior to issuance of building permits. 8. Staff approval of all plans prior to releasing the plat for recording. 9. All mailboxes shall be clustered. 10. Wetland impacts shall be reviewed and approved by the city and the appropriate state and federal agencies prior to releasing the plat. Background/Discussion The subject property is 17.56 acres in size and located west of Fillmore Street at the 178"' Avenue alignment. The property is zoned Single Family Residential (R1-c) and the applicant is also requesting a Zone Change (ZC 22-05) to PUD along with a Conditional Use Permit (CU 22-15) to develop a residential PUD consisting of detached villa style homes. The proposed preliminary plat includes 43 lots and three oudots. The oudots are encumbered by overhead power lines, private access easements, and wetlands which will not be developed in the future. Comprehensive Plan The subject site is guided for single-family residential uses. The plan notes that higher densities (townhomes and duplexes only) along primary transportation corridors and near existing areas of higher density. The proposed project is consistent with the Comprehensive Plan and develops the area at approximately 2.5 units/acre. CR 12 Public Utilities Updated plans propose a private lift station to support sanitary services for the four proposed lots on 187`h Court. The city has requested additional information from the developer to support the proposed lift Figure i station and demonstrate the need. Without a demonstrated need, staff will not support installation of a lift station. The conditions included for approval of the PUD require staff approval of all plans. This condition should be interpreted to provide staff authority to approve or deny the utility plans based on city standards and their professional review and judgement. Final Plat The applicant requests approval of the final plat for the first phase of The Villas at Fillmore. This phase includes 28 buildable lots and four oudots. Outlots A and B include the access easement for the parcel to the west along with a utility easement along the south 50 feet. These will not be replatted in the future. Oudots E and C include future developable lots and will be replatted with future additions. Park and Recreation The Park and Recreation Commission reviewed the project on July 13, 2022, and recommended cash dedication for the project. The developer spoke during the public hearing and outlined concerns regarding the cash dedication and trail costs along Fillmore. He requested a concession on the park dedication fee to accommodate a portion of the costs associated with the 10-foot trail. The Commission discussed the proposal and ultimately recommended full park dedication fees and construction of the trail. An outline of the developer's request is attached. Planning Commission During the public hearing, the property owner directly to the west indicated there are two easements located on the subject parcel for his use and wanted to make sure they were not removed with the request. He also questioned if he would have to pay any assessments. The access easements will be retained in the proposed outlots, and he will not be assessed for this project as the infrastructure will be installed at the developer's expense. The Planning Commission had no questions or concerns about the request and unanimously recommended approval of the project. Staff has not received any comments since the commission meeting. Staff does not believe there will be negative impacts to the road network, public utilities, or future park needs because of the requested zone change. This study was supplemented with an Appraisal study prepared by Patchin Messner Valuation Consultants in April 2016. The City's Park dedication ordinance was subsequently amended, in July 2016, to reflect the findings of these studies and to incorporate park dedication fee requirements that reflect the impacts of various types of development on the need for the acquisition, development and improvement of park land. The proposed development is a residential development which will create park land acquisition, development and improvement needs proportionate to the park dedication fee set by the park dedication ordinance; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED It is hereby determined by the City Council for the City of Elk River as follows: A. The proposed subdivision is consistent with the Chapter of 30 of the City Code of Ordinances and conforms with all of its requirements. B. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Plan. C. The physical characteristics of the site, including, but not limited to, topography, soils, vegetation, susceptibility to erosion and NATUREJ susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. 4.
