Background/Discussion
During the Ju1�T 18, 2022, `vork session, Chief Nierenhausen presented the proposed change to close parking in
municipal parking lots from 10:00 p.m. to 6:00 a.m. due to an increase in individuals stayTing in the park or parking
vehicles for an extended period of time.

An Ordinance Amending Chapter 74, Section74-93, Impoundment of Vehicles, of
the City of Elk River, Minnesota, City Code
The CityT Council of the CityT of Elk River does herebyT ordain as follo�vs:
SECTION 1. That Chapter 74, Section 74-93 shall be amended as follo`vs:
Sec. 74-93. Impoundment of vehicles.
Any police officeY may remove a vehicle from a street or public paYking lot, u�cludi�i� Uublic �ark
n�rki�ig lots, to a gaYage oY other place of safetyr when the vehicle is left unattended and constitutes
an obstruction to traffic or hinders snow removal or street improvement or maintenance operations.
Such vehicle shall not be released until the fees for towing and storage are paid, in addition to anyT
fine imposed for violation of this chapter.
SECTION 2. That this ordinance shall take effect upon adoption and be published as provided byT
la`v.
Passed and adopted by the CityT Council of the CityT of Elk River this 15th dayT of August, 2022.

ljTer An Ordinance Amending Chapter 74, Section74-99, Impoundment of
Vehicles, of the City of Elk River, Minnesota, City Code
The CityT Council of the CityT of Elk River does herebyT ordain as follows:
SECTION 1. That Chapter 74, Section 74-99 shall be amended as follows:
Sec. 74-99. Parking in municipal parking lots and �ublic �arks.
(a) The municipal parking lots along the Burlington Northern Railroad are designated for either
commuter or public parking. Where posted, time limits are enforced.
(b) Reserved.
(c) After 6:00 p.m. and until 8:00 a.m. MondayT through FridayT, and all dayT on `veekends, the King
Avenue paYking lot is open to any and all parking. (With the exception of 74-102, "Snow
Removal")
(d) The north section of the King Avenue lot shall have twentyT-six (26) posted spots designated
"Designated Snow Removal Parking On1yT, Nov. 15—April 15, 6:00 p.m.-8:00 a.m."

park after 10:00 �.m. or before 6:00 a.m. without the �rior written authorization of the Citt�.
(e� Violarions of this section aYe punishable as provided in secrion 74-91, and ma�r be subject to
im�oundment as �ro�rided in section 74-93.
SECTION 2. That this oYdinance shall take effect upon adoption and be published as provided by
la�v.
