The general purpose and intent of the ordinance are met. 2. The property has a land use of residential and the use is consistent with the Comprehensive plan. 3. The proposed use is reasonable and is permitted in the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction. 5. The variance will not alter the essential character of the locality and; with the following conditions: 1. The drain field shall maintain a minimum of 5 feet from the west property line and 4.5 feet from the detached accessory structure. Background/Discussion ywj The subject property requires a new drain field to be installed and the %g only place it can be located is in the same location of the existing drain field (field) which is currently located too close to the west property Figure I _ line and the detached accessory structure (shed). It is not known why the existing field was previously allowed in this location. The area located just east of the shed is too low and not suitable for a field. The subject parcel, located on the Mississippi River, is 1.14 acres in size and the field setback requirements are 10' from property lines and 20' from structures. To install the new field, the property requires a setback variance from both the west side property line and the shed. The field needs to be about 7' from the property line (10' required) and 4.5' from the shed (20' required). Updated. August 2020 The submitted site plan indicates the pressure bed may need to move a foot or two. Staff is recommending the field be no closer than 4.5' to the shed and 5' from the west property line. Applicable Regulation Variances may be granted when the petitioner establishes that the variance satisfies all five of the criteria described below. The variance is: 1. Is in harmony with the general purpose and intent of the ordinance, and The purpose and intent are to provide adequate separation between properties and structures. Along with the fact that the existing system is the same location and staffs analysis of the new design, the distances being proposed should not be of any concern. The proposal is in harmony with the general purpose and intent of the ordinance. 2. Is consistent with the City of Elk River comprehensive plan. The property is guided for residential uses which support on -site septic systems. The proposal is consistent with the city's Comprehensive Plan. Variances may be granted when the petitioner establishes that there are practical difficulties in complying with the zoning ordinance. Practical difficulties means that: 3. The petitioner proposes to use the property in a reasonable manner not permitted by the Zoning ordinance; The petitioner proposes using the property in the same manner as it has been for years, just now with an updated drain field. The use is reasonable. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petition's own action or inaction; and The physical characteristics of the site, which are not a consequence of the petitioner's own action or inaction, limit where the drain field can be located to where it is being proposed. 5. The variance, iifgranted, will not alter the essential character of the locality. Installing a drain field will not alter the essential character of the locality. Financial Impact None Council Meeting If denied, or an appeal is made by any interested party by September 2, 2022, this item will go to the September 19, 2022, City Council meeting. The single family home on this property was built and lived in by Lloyd and Maxine Barthel since 1972. It is the intent that this will continue to be a single family home property in the future. Maxine Barthel died in 2018. Lloyd Barthel continued to live in the home until his recent move to Guardian Angels by the Lake. The current septic system is not to code and the intent is to bring the property up to code for a single family dwelling which is in harmony with the general purpose and intent of the City of Elk River ordinances. A variance is requested due to the limitations of property lines in relationship to the established buildings and the street. This is further complicated because this property is on the Mississippi River. There is no new area available for a septic system, thus the new septic design essentially requires the old system to be removed and remediated so the new system may be placed in the same location. Depth to saturation and depth to bedrock are evaluated from the surface to a depth of 203 centimeters. The frequency of ponding and flooding also is evaluated. Excessive slope may cause lateral seepage and surfacing ofthe effluent indowne|ope areas. The ratings are both verbal and numerical. Rating class terms indicate the extent to which the soils are limited by all of the soil features that affect the specified use. "Not limited" indicates that the soil has features that are very favorable for the specified use. Good performance and very low maintenance can be expected. "Slightly limited" indicates that the soil has features that are favorable for the specified use. "Moderately limited" indicates that the soil has features that are moderately favorable for the specified use. The limitations can be overcome or minimized by special planning, design, or installation. Good performance and moderate maintenance can be expected. "Very limited" indicates that the soil has one or more features that are unfavorable for the specified use. The limitations generally cannot be overcome without special design or expensive installation procedures. "Extremely limited" indicates that the moil has one ormore features that are very unfavorable for the specified use. The limitations generally cannot be overcome. Numerical ratings indicate the severity of individual limitations. The ratings are shown as decimal fractions ranging from 0.01 to 1.00. They indicate gradations between the point at which a soil feature has the greatest negative impact on the use (1.UO) and the point atwhich the soil feature ianot alimitation (0.0O). Use the chart on page 6 to track your activities. Identify the service intervals recommended by your system designer and your local government. The tank assessment for your system will be the shortest interval of these three intervals. Your pumper/maintainer will determine if your tank needs to be pumped. Check (listen, look) for leaks in toilets and dripping faucets.. Repair leaks promptly. • Surfacing sewage. Regularly check for wet or spongy soil around your soil treatment area. If surfaced sewage or strong odors are not corrected by pumping the tank or fixing broken caps and leaks, call your service professional. Untreated sewage may make humans and animals sick. • Alarms. Alarms signal when there is a problem; contact your maintainer any time the alarm signals. • Lint filter. If you have a lint filter, check for lint buildup and clean when necessary. Consider adding one after washing machine. • Effluent screen. If you do not have one, consider having one installed the next time the tank is cleaned. Annually • Water usage rate. A water meter can be used to monitor your average daily water use. Compare your water usage rate to the design flow of your system (listed on the next page).. Contact your septic professional if your average daily flow over the course of a month exceeds 70% of the design flow for your system. • Caps. Make sure that all caps and lids are intact and in place. Inspect for damaged caps at least every fall. Fix or replace damaged caps before winter to help prevent freezing issues. • Water conditioning devices. See Page 5 for a list of devices. When possible, program the recharge frequency based on water demand (gallons) rather than time (days). Recharging too frequently may negatively impact your septic system. • Review your water usage rate. Review the Water Use Appliance chart on Page 5. Discuss any major changes with your pumper/maintainer. During each visit by a pumper/maintainer Ask if your pumper/maintainer is licensed in Minnesota. • Make sure that your pumper/maintainer services the tank through the manhole. Professionals should refer to the 01M Manual for detailed checklists for tanks, pumps, alarms and other components. Discuss any changes in water use and the impact those changes may have on the septic system. • Review water usage rates (if available) with homeowner. Septic Tank/Pump Tanks • Manhole lid. A riser is recommended if the lid is not accessible from the ground surface. Insulate the riser cover for frost protection. • Liquid level. Check to make sure the tank is not leaking. The liquid level should be level with the bottom of the outlet pipe. (If the water level is below the bottom of the outlet pipe, the tank may not be watertight. If the water level is higher than the bottom of the outlet pipe of the tank, the effluent screen may need cleaning, or there may be ponding in the drainfield.) • .Inspection pipes. Replace damaged caps. • Baffles. Check to make sure they are in place and attached, and that inlet/outlet baffles are clear of buildup or obstructions. • Effluent screen. Check to make sure it is in place; clean per manufacturer recommendation. Recommend retrofitted installation if one is not present. • Alarm. Verify that the alarm works. • ,Scum and sludge. Measure scum and sludge in each compartment of each septic and pump tank, pump if needed. Pump • Pump and controls. Check to make sure the pump and controls are operating correctly. • Pump vault. Check to make sure it is in place; clean per manufacturer recommendations. • Alarm, Verify that the alarm works. • Drainback. Check to make sure it is operating properly. • Event counter or run time. Check to see if there is an event counter or ran time log for the pump. If there is one, calculate the water usage rate and compare to the anticipated average daily flow listed on Page 2. Soil Treatment Area • Inspection pipes. Check to make sure they are properly capped. Replace caps that are damaged. • Surfacing of effluent.
