Background/Discussion
The properties are zoned Commercial Reserve Transition (CR'I� where
changeable copy signs larger than 30 squaYe feet require a Conditional
Use Permit (CUP). The applicant is seeking a CUP to install a
monopole monument sign with an 81 square foot changeable copyT
portion of the sign. The oveYall sign is appYoxirnately 11'-9" x 12'-4"
with the changeable cop�T being around 6'-9" x 12'-0".
The commercial business office/yTard is located on parcel 75-110-2400
and the sign is located on parcel 75-789-0010. These t�vo parcels are
considered a Zoning Lot which can be regulated as one parcel.
Surrounding uses include a commercial kennel to the north, mining to
the northeast, off road racing facilities to the east and south, with
reclaimed mine to the west across High`vayT 169.

Applicable Regulations
In approving a Conditional Use Permit, the council mayT impose such specific conditions with regard to the
development or opeYation of the pYoposed use as it consideYs necessary to sarisfy the seven standards set foYth in
Section 30-654 and the requirements contained in this article and to promote compatibilityT with and minimize anyT
potentiallyT adverse effects upon adjacent properties, the neighborhood or the cityT.
The issuance of a Conditional Use Permit can be ordered only if the use at the pYoposed location:

The sign is located about 840' from the nearest residential structure which greatly- limits exposure to the lit
sign. The sign is also positioned approximatel�r 50 feet behind (east) where a vehicle would be queued to
make a tuYn onto Highway 169 from 217�' and 219`i' Avenue.
With the standaYds set foYth in Sec. 30-864 (e), the use will not endangeY, injuYe oY detrimentally affect the
use and enjoyment of otheY pYopertyr in the immediate vicinity or the public health, safet�r, moYals,
comfort, convenience or general `velfare of the neighborhood or the city.
2. LVill l�e consistent �a�itb the Colnpr•ebensive Plan.
The pYopeYtyr the sign is located on has a land use designation of Rural Residential but the pYopeYtyr that it
is adjacent to, which has the commercial business office/yard, is designated as Highway Business. The
High��ayT Business categoryT allo`vs for a`vide varietyT of uses, including signs accessory to approved uses.
The use will be consistent tivith the Comprehensive Plan.
Staff does not see a need to impose specific conditions to satisf�T this standard.
3. LVill not i�npede the no��nal and o��e�•ly develop�nent and ilnp�ove�nent of suT�ounding vacantp�ope��y.
There are vacant parcels west of the subject parcel, across Highwa�T 169, and the surrounding properties
on the east side of Highway 169 are developed to some level. The changeable copy sign will not impede
the normal and orderlyT development and improvement of that vacant propertyT.
Staff does not see a need to impose specific conditions to satisfy this standard.

The sign `vill not create traffic congestion or interfere with traffic on adjacent and neighboring public
thoroughfaYes. As stated in standaYd #1, the sign is positioned approxirnately 50 feet behind (east) wheYe
a vehicle would be queued to make a turn onto Highway 169 from 217`�� and 219`�� Avenue. It will not
interfeYe with motorists making tuYns. It is also setback appro�mately 85 feet from the drive lane of
Highway 169 which should not interfere with the traffic.
Staff does not see a need to impose specific conditions to satisfy this standard.
5. LVill not involve uses, activities, p�ocesses, lnate�zals, egupinent and conditions of ope�ation that aa�ill I�e detTzlnental to any
pe�:sons o�•p�opeT�y because of excessive t�a�c, noise, s�noke, fu�nes, gla�e, odo�:s, dust or vil�rations.
As was stated in Standard #1, the sign is located about 840' fYom the neaYest Yesidential structuYe. With
the standards set forth in Sec. 30-864 (e), the use `vill not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any persons or property because of
excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations.
Staff does not see a need to impose specific conditions to satisfy this standard.

The installation of a monopole fYeestanding sign will not result in the destruction, loss oY damage of a
natural, scenic or historic feature of major importance.
Staff does not see a need to impose specific conditions to satisfy this standard.

Albrecht Sign is proposing an 11'-8 7/8" X 12'-3 3/8" sign with an electronic message center
(EMC). Overall combined square footage is 144 SF; the top cabinet is 4'-4" X 11'-11 3/8" (52 SF)
and illuminated with white LEDs. The EMC is 6'-9" X 12', with an active viewing are of 6'-3" X
11'-9" (73.45 SF). There is a 2' reveal and 4" painted crown. The overall height of the sign will
be 30', with a 4' X 10' footing. The pipe is a 16" schedule 40 with %z" wall. The sign will be
located outside of the required 45' setback from the wetlands, as shown on Sign Design REV 5,
dated 8/8/22.
The EMC will be used to promote products and sales for Greenscape Companies, as well as
public service announcements. The content will meet all sign code requirements, including
frequency of inessage changes.
