Wall signage on the parcel shall not exceed 15 percent coverage on the west elevation. Background/Discussion The property is zoned Planned Unit Development (PUD) where deviations from a previously approved Conditional Use Permit (CUP) require an amendment to the CUP. With the approval of the CUP in 2002 (CU 02-13), the project was approved to have signage only on the ends (north and south side) of the pharmacy drive-through canopy. With the replacement of the pharmacy by a bank, the applicant is seeking a CUP to add signage to the west side of the drive-through canopy. Applicable Regulations In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. Updated: August 2020 The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. The subject parcel is in a commercial development with the façade of the proposed sign facing Evans Street and Highway 169. A residential district is directly east of the subject parcel, but the proposed sign is facing west. If the property were zoned C3 Highway Commercial, the structure would be allowed to have wall sign area up to 15 percent of façade area. With the proposed signage, there will be approximately 8 percent of coverage on the building. As the use will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience, or general welfare of the neighborhood or the city, staff recommends the wall signage on the west building façade not exceed 15 percent coverage. 2. Will be consistent with the comprehensive plan. The property has a land use designation of Highway Business which allows for a wide variety of uses, including signs accessory to approved uses. The use will be consistent with the Comprehensive Plan. Staff does not see a need to impose specific conditions to satisfy this standard. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. There is one vacant commercial parcel south of the subject parcel which is also owned by Coborns, the owner as the subject parcel. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. The sign is setback approximately 250 feet from the drive lane of Evans Street which should not interfere with the traffic. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. Signs are an expected use within a commercial development and if the property were zoned C-3, the proposal would not exceed what is allowed. Staff does not see a need to impose specific conditions to satisfy this standard. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city.
