Adopt, byT motion, a resolution approving the Plat of BeaudryT Elk River Addition with the follo�ving conditions:
1. The wetland boundaryr shown on the plat shall be updated to reflect the final approval given by the
Technical Evaluation Panel (TEP).
2. The TEP shall approve all proposed wetland impacts and fill prior to releasing the final plat for approval.
3. The applicant shall provide documentation demonstrating compliance with the wetland replacement
standaYds having been met.
4. Final established wetland boundaries, based on the TEP approved �vetland impacts, shall be identified on
the plat along with a 45-foot dYainage and utilit�r easement.
Background/Discussion
Case No. P 22-12
The applicant requests approval of a plat that adjusts the propertyr lines
of two e�sting parcels, dedicates right-of-`vayT for Elk Lake Road, and
creates an outlot for future development The buildable lot created by
the plat will allow development of a warehouse and storage facilityT to
suppoYt the business operations of the applicant.
Land Use and Zoning
The Comprehensive Plan guides the site for industrial uses and no
amendments to the adopted plan will be Yequired to suppoYt the
proposed uses.
The subject site is zoned Light Industrial (I-1) wheYe waYehousing and
office uses aYe a peYmitted use. FutuYe development of the site will
require site plan approval and permitting through the building
department.

Wetlands and Natural Features
The site includes laYge wetland aYeas proposed to be filled as paYt of the planned waYehouse and paYking
improvements to the site. The wetland impacts require approval from the Technical Evaluation Panel (TEP) prior
to cit�r issuance of an permits for improvements that would impact the wetland areas. The TEP is established
through the MN Wetland Conservation Act (WCA) and reviews all proposed wetland delineations and wetland
impacts within the cityT.
This project is still under review by the TEP due to the proposed `vetland impacts. Staff has included several
conditions to ensure this project and all future improvements comply with the WCA.
Transportation
The site is located along CountyT Road 1 and the applicant has proposed t�uo drivewayT entrances. Sherburne
County has reviewed and approved the proposed driveways.
Applicable Regulations
Cit�T ordinance section 30-375 outlines the required findings for approval.
9. The proposed sul�division is consistent �a�itb the �oning T eaulations (aT7icle VI of this chapter� and confor7ns in all respects 2a�ith
all requiz elnents of tbis Code, including the �oning a egulations and tbis a�7icle.
The pYopeYtyr is zoned Light Industrial (I-1) and the pYoposed paYcels cYeated with this subdivision meet all
dimensional standaYds outlined in the oYdinance. FutuYe development of the site will comply with
applicable state and local codes.

The pYopeYty will be consistent with all applicable plans. SherbuYne Countyr has also evaluated the pYoject
for compliance `vith countyT access standards and roadwayT planning.

The site has wetlands that will be impacted as paYt of the proposed development pYoject. Additionally, the
applicant must demonstrate compliance with the cit�r's storm`vater and erosion control standards as during
the peYmitting process.

The subdivision will include infrastructure to meet city requirements. Additional permits required to
complyT with erosion control standards are required and `vill be secured prior to building permit issuance.

wetlands are Yeviewed in accordance with the WCA and must be approved byr the TEP. The full scope of
those impacts must be approved prior to releasing the plat for recording. Staff has included several
conditions to ensure these standards are met.

The subject site includes utilit�T easements that preserve access to public services. These easements are

There are a few vacant parcels in the area `vhich are guided for similar uses. The proposed subdivision `vill
not impact reasonable development of neighboring land.

A Resolution of the City Council of the City of Elk River Granting Plat
Approval for Beaudry Elk River Addition, Case No. P 22- I 2
WHEREAS, application has been made foY plat approval, puYsuant to Section 30-392 of
the Elk River City Code of Ordinances, of the propert�T legallyT described on attached Exhibit
A and hereinafter referred to as "the Property"; and
WHEREAS, a final plat of the PropertyTwas approved byT the City Council on November
7, 2022.
NOW, THEREFORE, BE IT RESOLVED byT the CityT Council of the CityT of Elk
River, iVlinnesota, as follo`vs:
The Cit�T Council makes the follo`ving findings of fact:
A. The proposed subdivision is consistent with Chapter of 30 of the CityT Code
of Ordinances and conforms `vith all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized cityr, county; and regional plans including, but not limited to, the
CityT's Comprehensive Plan.
C. The phyrsical chaYacteristics of the site, including, but not limited to,
topographyT, soils, vegetation, susceptibilityT to erosion and siltation,
susceptibilityT to flooding, and drainage are suitable for the ty-pe and density
of development and uses contemplated.
D. The proposed subdivision makes adequate provision for `vater supply, storm
drainage, sewage transportation, erosion control and all other services,
facilities and improvements other�vise required herein.

damage.
The proposed subdivision `vill not conflict `vith easements of record or `vith

2. Plat approval is hereby gYanted for the PYopeYtyr, subject to the conditions set foYth
in attached Exhibit B.
The officers of the Cit�T are herebyT authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the plat for the PropertyT and to issue a
certified copy of this Resolution giving final approval of the plat.
4. The owneY of the PYopertyr is authorized to recoYd the final plat as Yequired byr law
and shall file proof of said recording `vith the CityT. No building permits will be
issued for the Propertyr until the final plat is recoYded.
This final plat approval shall expire two yTears from the date of this resolution if the
final plat is not YecoYded within that time.
