4.1. PCSR 11-22-2022Request for Action To Item Number Planning Commission 4.1 Agenda Section Meeting Date Prepared by Public Hearings November 22, 2022 Zack Carlton, Community Development Director Item Description Reviewed by RAN Properties/GATR – 75-915-0020 Chris Leeseberg, Senior Planner  Preliminary Plat of Natures Edge Business Reviewed by Center Forth Addition, Case No. P 22-14 Action Requested Recommend, by motion, approval of the Preliminary Plat of Natures Edge Business Center Fourth Addition with the condition that the closing for the purchase of city-owned property occurs in conjunction with the recording of the plat. Background/Discussion The applicant, RAN Properties/GATR, is proposing to split the city- owned property that was included as part of the road and utility extension project near Cargill and GATR Truck Center earlier this year. The applicant has been working with the City Council to acquire a portion of the parcel to support a future expansion of the GATR operation. The plat creates two outlots to support future development opportunities. Each of the two parcels meets the minimum lot size standards for a future buildable lot, should business needs change in the future. Any future use of these lots will require additional platting. Applicable Regulations Preliminary Plat City ordinance section 30-375 outlines the required findings for approval of a Preliminary Plat. 1. The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the zoning regulations and this article. The property is zoned Business Park, and the proposed parcels meet all dimensional requirements. As the lots are being platted as outlots they will not be developable without additional platting in the future. Development within the subdivision will not be possible with the current application. The proposed subdivision is consistent with all zoning regulations. The Elk River Vision A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community engagement that encourages and inspires prosperity. Updated: August 2020 2. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. The property is guided for industrial uses and makes adequate provisions for protection of the regional stormwater features. The subdivision is consistent with all applicable plans. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. The physical characteristics of the site are suitable for the type and density of development and uses contemplated. 4. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required in this article. The outlots being platted are served by city utilities, but development may not occur until the parcels are platted into a lot/block configuration in the future. Infrastructure and service impacts will be reviewed more closely as part of a future platting application. 5. The proposed subdivision will not cause substantial environmental damage.
