Background
Labor Rates
Various general labor rates are adjusted to reflect current labor costs more accurately within the respective
departments. Fees adjusted are Labor Rates, Staff Service, Police Reserve, and Off Duty Officer Services.
Licensing Fees (pg. 2)
Two new liquor permits authorized by the legislature and discussed by Council at a previous meeting. Growlers
Off-Sale permit reduced to $100 to better reflect actual cost. Cannabis license is a new fee and license.
Garbage, Sewer, Stormwater, SAC (pgs. 3, 4, 8)
Council reviewed during budget discussions. Extra garbage stickers were discontinued during the pandemic and
ERMU offices were closed. Residents now contact the hauler directly to schedule an extra trash bag pickup and pay
for it over the phone.
Wetland Conservation Act (pg. 4)
Wetland permit fees were changed from $40 to $200 in 2019. Review of wetland fees from surrounding
communities revealed that our fee is among the lowest. Staff proposes increasing this fee to $400 for a wetland
permit application and increasing the no-net loss review letter to $75 to account for staff research, investigation,
and documentation.
Shoreland, Filling & Grading and/or Alteration Fees (pg. 4)
Alteration fees were added to compensate for staff’s time required to address and mitigate an increased amount of
time working on shoreland filling, grading, and/or wetland violations.
Planning/Development Fees (pgs. 4-9)
Due to the absence of any major building permit fee changes over the past 10-15 years, the new building official
conducted a permit fee comparison with the surrounding communities. These jurisdictions included those closest in
proximity to Elk River: Big Lake, Monticello, Sherburne County, Zimmerman, Otsego, Rogers, St Michael,

Albertville, Maple Grove, St. Francis, and 13 jurisdictions overseen by the private inspection company, Rum River
Consultants.
According to this comparison, Elk River’s building permit fees were, on average, significantly lower than peer
groups. Based on these differences, and an analysis of staff time spent on permits and inspections, staff is
proposing to adjust building permit fees to align with the average/lower average of the surrounding communities.
The proposed changes appear either as an increased flat fee, or as an additional plan review fee. The addition of the
plan review fee allows the city to recoup costs on the review and administration of the permit in addition to the on-
site inspection time. This change is consistent with the results of the fee comparison review.
Micro Loan Program (pg. 6)
Reviewed by the Economic Development Authority and reduced from $2,000 to $500.
Sanitary Sewer User Fee (pg. 8)
This is an annual increase according to fund analysis on bond repayment.
Open Burning Permit (pg. 11)
Fee listed incorrectly. Should be an annual fee, not per permit. Special Burn Permit fee eliminated per Council
approval of Ordinance Changes in 2022.
Fire Station Room Rental (pg. 12)
Fee for use of classroom, meeting room at Fire Station #3 for residents and non-residents.
Elk River Municipal Utilities (Exhibit C)
ERMU Commission adopted their fees in October. The city attorney recommends the fees be listed as part of the
city fee schedule.

Who Should Pay Fees?
Council can set fees to fully recover the cost of a service or set a lower fee to provide a certain level of
subsidy, or alternatively, reduce costs by reducing the level of service.
Some programs and services may justify a subsidy from a tax based or alternative revenue source. For
example, community supported public services based on social, safety, or general community welfare.
Services supporting the general public, such as public safety, are supported by tax and other non-fee
revenues, while services more elective in nature and of specific benefit to individuals are typically
supported by charging fees to the user.
Within the services typically funded by user fees, there are several reasons a Council may not advocate for
full cost recovery of services. The following factors are some key policy considerations when setting fees
at less than 100 percent of cost recovery:
Encouragement of desired behaviors. Keeping fees for certain services below full cost recovery
may provide better compliance from the community. For example, if the cost of a permit for a
residential tree removal is higher than the cost of the actual removal of the tree, many citizens will
avoid getting the permit.
Effect on demand for a particular service. Sometimes raising the “price” charged for services
might reduce the number of participants in a program. This is largely the case in recreation programs
such as camps or enrichment classes, where participants often compare the city’s fees to surrounding
jurisdictions or other options for leisure activities.
Benefit received by user of the service and the community at large is mutual. Many services
that directly benefit a group or individual equally benefit the community as a whole. Examples
include recreation programs, planning design review, historical dedications, and certain types of
special events.

An Ordinance of the City of Elk River
Adopting the 2023 Master Fee Schedule
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1.
1. Policy and Purpose: By the enactment of this Ordinance, the City Council intends to
establish fees and charges required by the City Code for the year 2023 and to comply with
Minnesota Statutes, 462.353, sub. 4.
2. Fees and Charges: The fees and charges for the city for the year 2023 are as set forth on the
attached Exhibit A, B, and C.
3. Application: Where a direct conflict exists between the amount of a fee or charge set by any
provision of the City Code and a fee or charge set by this Ordinance, the fee or charge set by
this Ordinance applies.
SECTION 2. This ordinance shall become effective January 1, 2023

A Resolution of the City of Elk River Approving Notice of Summary Publication of
Ordinance #22-___ an Ordinance Adopting the 2023 Master Fee Schedule
WHEREAS, on November 21, 2023 the Elk River City Council adopted Ordinance 22-__
approving the 2023 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the City
Code and to comply with Minnesota Statutes 462.353, sub.4; and
WHEREAS, the 2023 Master Fee Schedule lists fees and charges for Administrative, Financial,
Environmental, Planning, Development, Building, Parks and Recreation, Fire, Police, and Elk River
Municipal Utility services along with code enforcement violations; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the
Office of the City Clerk, City of Elk River, 13065 Orono Parkway, during regular business hours –
8:00 a.m. to 4:30 p.m., Monday through Friday; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: by at least four-fifths vote, authorizes the publication of the title and
summary of Ordinance 22-__ and that Ordinance 22-__ shall become effective January 1, 2023.
