Background
The City Council, on November 21, 2022, adopted the 2023 Master Fee Schedule. However, a public hearing was not
called and resolution for summary publication of the ordinance was not approved. To save on publication costs, a
resolution authorizing a summary publication is recommended.

Who Should Pay Fees?
Council can set fees to fully recover the cost of a service or set a lower fee to provide a certain level of
subsidy, or alternatively, reduce costs by reducing the level of service.
Some programs and services may justify a subsidy from a tax based or alternative revenue source. For
example, community supported public services based on social, safety, or general community welfare.
Services supporting the general public, such as public safety, are supported by tax and other non-fee
revenues, while services more elective in nature and of specific benefit to individuals are typically
supported by charging fees to the user.
Within the services typically funded by user fees, there are several reasons a Council may not advocate for
full cost recovery of services. The following factors are some key policy considerations when setting fees
at less than 100 percent of cost recovery:
Encouragement of desired behaviors. Keeping fees for certain services below full cost recovery
may provide better compliance from the community. For example, if the cost of a permit for a
residential tree removal is higher than the cost of the actual removal of the tree, many citizens will
avoid getting the permit.
Effect on demand for a particular service. Sometimes raising the “price” charged for services
might reduce the number of participants in a program. This is largely the case in recreation programs
such as camps or enrichment classes, where participants often compare the city’s fees to surrounding
jurisdictions or other options for leisure activities.
Benefit received by user of the service and the community at large is mutual. Many services
that directly benefit a group or individual equally benefit the community as a whole. Examples
include recreation programs, planning design review, historical dedications, and certain types of
special events.

CONCESSION STAND USE-TOURNAMENTS
Deposit
All users/associations/tournament organizer will pay a $500, refundable deposit on an annual basis/per
tournament. The refundable deposit will help ensure user/association accountability for damage to fields,

facilities and/or scoreboard controllers. If the deposit is used for any of the above-mentioned items, the
user/association will replenish their deposit back to the full amount of $500

All users will pay for restroom cleanings deemed necessary by city staff based upon the event attendance

A Resolution of the City of Elk River Approving Notice of Summary Publication of
Ordinance #22-___ an Ordinance Adopting the 2023 Master Fee Schedule
WHEREAS, on November 21, 2023 the Elk River City Council adopted Ordinance 22-__
approving the 2023 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the City
Code and to comply with Minnesota Statutes 462.353, sub.4; and
WHEREAS, the 2023 Master Fee Schedule lists fees and charges for Administrative, Financial,
Environmental, Planning, Development, Building, Parks and Recreation, Fire, Police, and Elk River
Municipal Utility services along with code enforcement violations; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the
Office of the City Clerk, City of Elk River, 13065 Orono Parkway, during regular business hours –
8:00 a.m. to 4:30 p.m., Monday through Friday; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: by at least four-fifths vote, authorizes the publication of the title and
summary of Ordinance 22-__ and that Ordinance 22-__ shall become effective January 1, 2023.
The motion for adoption of the foregoing resolution was duly seconded by Councilmember
