Request
Consider a request by the City of Elk River to vacate a portion of right -of-way for Parrish
Avenue.
Location
The proposed easement vacation is located on the southwest comer of Main Street and
Parrish Avenue.

Overview
The City is proposing to vacate a portion of Parrish Avenue right-of-way at the intersection
of Main Street. This will allow for Metro Plains to construct the underground parking lot for
the Bluff Block building as proposed. Additional comments can be found in the City
Engineer's memo.

Recommendation
Staff recommends that the City Council approve the attached Resolution No. OS-_
vacating a portion of the right-of-way of Parrish Avenue with the following condition:
1. All comments of the City Engineer shall be addressed.

Dear Mr. Harlicker:
As requested, I have reviewed the legal description for the proposed right-of-way vacation
along the west side of Parrish Avenue adjacent to the Bluff Block development. This
proposed right-of-way vacation was initiated by the City of Elk River in conjunction with the
MetroPlains development of the Bluff Block. The approved building plan has underground
parking which extends easterly into the right-of-way proposed to be vacated. The area in
question is approximately .12 acres and is an old site triangle area from the original
construction of Trunk Highway 10. The proposed vacation will have no affect on the
operation of Main Street or Parrish Avenue. The small utilities that are located in this right-
of-way would need to be relocated regardless, because of the underground parking
component of the Bluff Block development.
I would recommend approval of the proposed vacation so that the area vacated can be
attached to the Bluff Block. This will allow for the underground parking to be built within
the Bluff Block lot. If you have any questions regarding this issue, please call.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING A PORTION OF STREET EASEMENT
Case No. EV 05-10
WHEREAS, On October 20, 2005 the City of Elk River requested that the City Council
vacate the public interest in Jackson Square according to law; and,
WHEREAS, a public hearing was held on November 7, 2005 before the City Council at
the Elk River City Hall on such petition after due published and posted
notice had been given as well as personal notice to affected property owners
on October 27, 2005 and all persons interested were given an opportunity to
be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the street, drainage, and utility easements described as follows is hereby
vacated:
