SUBJECT: Comparable Worth Appeal of Ice Arena Supervisor jerry Davis
Jerry Davis, Ice Arena Maintenance Supervisor, is appealing to the City Council his
position's point value as assigned by the Personnel Committee following extensive review of
his position and as reaffIrmed by an internal appeal to the city administrator.
The fIrst attachment to this memo is a summary of titled Personnel Committee Overview
that provides additional information on the Personnel Committee's role, the pay equity law,
and the evaluating of positions. As you know, according the pay equity law, the city is
required to have a job evaluation system that determines the relationship of jobs to one
another. The city uses a system that was developed jointly by many cities in conjunction with
a consulting fIrm. Currently, the Center for Evaluation Research supports this job evaluation
system. They do a computer analysis to determine the point value of each position, typically,
based on a job analysis questionnaire 0AQ) completed by an employee. The point values
are assigned to positions based on the complexity of tasks, the importance of the position as
a whole and within the department, and unfavorable work conditions. Employee
performance, longevity, department size, and other factors are not determining factors in the
point value. The employee and department head review and approve the position prof1le
that is generated by the JAQ. This helps ensure that the point value is based on an accurate
list of duties and responsibilities of the position. The position is then placed on the city's
pay plan based on the point value.
Below is a brief outline of the process that has been completed to this point regarding this
position:

November 22, 1999- Jerry Davis hired to f1ll the ice arena maintenance supervisor
position. This position had a point value of 58 points at that time.

Late 2003-The Personnel Committee receives a request to review the ice arena
maintenance supervisor position based on a recommendation from his supervisor
that there was a substantial change in job duties.

February 3, 2004-Mr. Davis completes a job analysis questionnaire resulting in a
position profile that is reviewed, corrected, and approved by Mr. Davis and his
Supervisor Rich Czech.

April 23, 2004-Personnel Committee reviewed position profile as approved by Mr.
Czech and Mr. Davis. Center for Evaluation Research assigned point value of 58
points is approved by the Personnel Committee.

April 4, 200s-Personnel Committee discusses ice arena maintenance supervisor
position based on comments from ice arena manager indicating that Mr. Davis is not
pleased with the results of the Personnel Committee's recommendation. The
Personnel Committee discusses this request and recommends that since the process
was completed in accordance with the Personnel Committee guidelines, and since
the profile was approved by both the ice arena manager and the maintenance
supervisor, the Personnel Committee could not arbitrarily change the point value and
Mr. Davis would need to go through the formal appeal process to the city
administrator.

May 16, 200s-Position appealed to city administrator. Parks and Recreation Director
Bill Maertz, Rich Czech and Jerry Davis, along with city administrator Pat Klaers,
meet with the Personnel Committee to review Mr. Davis's appeal. Mr. Davis
presented his case on why he was not in agreement with the Personnel Committee's
recommendation. Based on the information presented and discussed at that meeting,
all present recommended that a new job analysis questionnaire be completed to
ensure that all of Mr. Davis's duties were included in a revised position profile.
o Bruce West spends several hours with Mr. Davis and Mr. Czech completing
a new JAQ. All agree that it fairly represents the duties of the position.

June 16, 2006-The Personnel Committee reviews the revised position profile
generated from the new JAQ that approved by the parks and recreation director, the
ice arena manager, and Mr. Davis. The Center for Evaluation Research assigns 58
points to the position. This is the exact value that was assigned previously. The
Personnel Committee recommends that 58 points be assigned to this position.
However, the appeal to the city administrator will continue and the city administrator
will have the opportunity to over-ride the Committee's decision.

July 15, 200s-City Administrator Pat K.laers rules on the appeal and determines that
he "decided to reject the comparable worth point ranking for Ice Arena Supervisor
Jerry Davis."
You can see that this was a long and detailed process. Throughout the process, the
Personnel Committee made every effort to ensure the Mr. Davis's was treated fairly and that

he had opportunities to change the job duties and responsibilities until he agreed that they
were correct.
Finally, attached you will find numerous pieces of background information to help you
respond to this appeal including a letter from Mr. Davis. Several members of the Personnel
Committee, as well as Mr. Davis, Mr. Czech, and Mr. Maertz will be present on Monday to
provide additional information to the Council on this appeal.

PERSONNEL COMMITTEE OVERVIEW
THE PAY EQUITY LAW
· The Minnesota Legislature approved the Local Government Pay Equity Act in
1984.
· In summary, the pay equity law requires equal pay for equal work.
· Determining equal pay for equal work requires a job evaluation system to
determine the relationship of jobs to one another.
· Requires that all jurisdictions file pay equity reports with the Department of
Employee Relations (DOER) every three years.
· DOER has developed a complex formula to determine compliance with the Act.
· Elk River's next report is due in 2002 for pay on December 31, 2001. (The
report is for the actual employees, pay, and point values as they existed on
December 31.)

WHAT ROLE DOES PC PLAY IN DETERMINING POINT VALUE?
. PC determines if position meets criteria for review.

. PC sends information to consulting fum.
o Consulting fum uses computer program developed by Control Data.

I'm asking the city council to increase my wages at a level comparable to other cities.
I have jumped through the hoops the city has asked, I have filled out the "position
profile" for public works, and have been turned down for a wage increase, because of the
score on the ''position profile'\ The problem I have with the ''position profile" is that it
does not pertain to the Ice Arena, in fact it does not even mention "Ice Arena", I do not
know how I can be graded on my job performance if the profile does not allude to the Ice
Arena.
I understand that the job of ' 'Maintenance Supervisor" for the Ice Arena is new to the
City and may not be fully understood. I have been asked to get job descriptions and
wages paid by other cities to compare to the City of Elk River.
$30.00/hr, Chaska, a two rink complex with pool. The Maintenance Supervisor does
some compressor and Zamboni work, however, the city garage does most
Zamboni repairs. The Supervisor has been on the job since 1991.
$27.34/hr, Plymouth, The arena has four full time employees and the lead person does
not perform compressor top end etc., the work is done by outside contractors
The lead person has been with Plymouth for six years. They have 3 rinks.
$25.00/hr, Brooklyn Park, they have 2 rinks with five full time employees. The lead
person has been on the job for three years. The Zamboni work is performed
by the city shop and the compressor work is done by outside contractors.
$24.50/hr, Hastings, wages going to $25.11 the first of the year, they have 2 Rinks.
The lead person does not perform any of the compressor work, however, does
Work on the Zamboni. The lead maintenance has been on the job 7 years.
$24.02/hr, Roseville, has one sheet of ice, the Maintenance Supervisor does some work
on the compressors and Zamboni, he has been on the job or 30 years
$20.06/br, Elk River, 2 Rinks, Ass't Manager in absent of Manager, over 5 years onjob,
24 years in this type of work, performs major compressor and Zamboni work,
responsible for all building maintenance and equipment repairs and has
much contact with the public.
Hastings appears to be the most similar to Elk River, therefore, I believe a wage
adjustment of no less than $24.25/hr would be comparable.

Ice Arena Maintenance Supervisor Jerry Davis has appealed his city comparable worth (pay equity
law) point ranking. On May 16, 2005, the Personnel Committee, Bill, Rich, Jerry, and myself met to
discuss this position and situation. Following this May 16 meeting, a new Job Analysis Questionnaire
(JAQ) was completed by Jerry Davis. This JAQ was reviewed by Jerry's supervisor Rich Czech and
was deemed to be an accurate reflection of Jerry's duties and responsibilities.
This JAQ was sent to PDI (consulting firm) for evaluation. PDI subsequently established a point
ranking of 58 for this position. This point ranking of 58 is identical to the previously established
point ranking for the Ice Arena Maintenance Supervisor.
After discussions with some of the above listed staff members and further review of this position
and situation, I have decided to reject the comparable worth point ranking appeal for Ice Arena
Maintenance Supervisor Jerry Davis.

Position Summary
The Ice Arena Maintenance Supervisor is responsible for general operations and maintenance of the
Ice Arena and it's equipment. Is acting manager in the absence of the Ice Arena Manager.
Essential Functions
1. Assists in the day-to-day operations of the Ice Arena.
A. Maintains receipts of ticket sales, skate sharpening and any other Ice Arena sales to
assure an accurate accounting of cash received.
B. Supervises other personnel to maintain arena effectiveness.
C. Carries out and enforces Ice Arena policies and practices.
D. Insures that safety and security measures are enforced.
E. Keeps Ice Arena Manager informed of important developments that he/ she will
need to know to effectively manage the operation of the arena.
F. Performs other duties or assumes other responsibilities as apparent.
2. Provides maintenance functions of the Ice Arena and equipment.
A. Assists in maintaining ice sheet in optimum condition when the arena is open to the
public.
B. Carries out maintenance activities and preventive maintenance programs on arena
machinery and equipment.
C. Provides general maintenance of the Ice Arena and grounds to ensure a clean and
safe facility.
D. Ensures necessary repairs are made promptly.
E. Inspects and corrects any ice surface defects.
F. Identifies any maintenance problems with the ice refrigeration and resurfacing
equipment and notifies supervisor.
3. Performs equipment operations.
A. Operates Ice Arena refrigeration equipment.
B. Operates resurfacing equipment in a safe manner, keeping ice hours on schedule.
4. Provides customer service related functions.
A. Sharpens skates.
B. Supervises skating and other events held at the Arena.

A. Assists in assigning work load to part-time Ice Arena employees.
B. Trains maintenance personnel in Ice Arena equipment operations.
C. Supervises part-time employees as necessary.
6. Performs other essential job duties.

Required Knowledge, Skills, and Abilities
D Knowledge of ice arena equipment to readily diagnose operating problems to minimize
downtime.
D Knowledge of proper maintenance procedures.
D Knowledge of refrigeration/ice making equipment operation and maintenance.
D Skilled in operating custodial maintenance equipment.
D Ability to account for cash receipts and operate a cash register.
D Ability to train and supervise staff and part-time employees.

Minimum Qualifications
D Technical school courses in ice arena management or a combination of training and
expenence.
D High School diploma or equivalent.
D Valid Minnesota driver's license.
D Past experience with ice arena refrigeration systems and resurfacing machines.
Preferred Qualifications
D Postsecondary degree in arena maintenance or related field.
D Experience in facility maintenance and supervision.
D Knowledge of ice arena administration and operations.
D Knowledge and experience of mechanical equipment necessary to operate an ice arena.
Physical Demands
D On a continuous basis, must be able to be on your feet, walk long distances, and climb stairs.
D On a frequent basis, must be able to bend, stoop, kneel, and crawl around confined areas.
D On a continuous basis, must be able to grasp levers.
D On a frequent basis, must be able to lift 20 lbs. from floor to waist and have the ability to
carry it over 250 feet.
