Action Requested
Adopt, by motion, a resolution amending the Comprehensive Plan
changing the land use from Traditional Single -Family Residential to
Highway Business.
Background/Discussion
Case No. LU 22-04 - Due to an oversight during the Comprehensive
Plan update in 2021, the property was inadvertently guided for
Traditional Single -Family Residential when is should have continued to
be guided as Highway Business, as it was prior to the adoption of the
current land use map.
The 3.96-acre site is located at the northeast intersection of Evans
Street and 196th Lane. The surrounding uses are commercial and
residential.
Planning Commission
During the public hearing, no one spoke for or against the request and
staff has not received any comments since the commission meeting.
The Planning Commission had no questions or concerns about the
request and unanimously recommended approval.

A Resolution of the City Council of the City of Elk River Amending the
Comprehensive Plan to Change the Land Use from Traditional Single -Family
Residential to Highway Business
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure
for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on November 22, 2022, and
recommended approval regarding the Comprehensive Plan amendment request for the
property described as: Lot 1, Block 1, Zvlstra Addition, Sherburne County, NIN, and
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request
and finds the following:
1. The proposed land use is consistent with the surrounding land uses.
2. The use would not have adverse impacts on the surrounding land uses.
3. The proposed changes are in general conformance to the adopted
Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows: The Land Use Plan be amended to change the property as
described above from Traditional Single -Family Residential to Mixed Residential.
Passed and adopted this 19`I' day of December 2022.
