BOA DRAFT MINUTES 12-20-2022 Meeting of the Elk River Board of Adjustments Held at Elk River City Hall Tuesday, November 22, 2022 Members Present: Vice Chair Perry Beise, Commissioners Dennis Booth, Eric Johnson, Craig Keisling, and Tony Mauren Members Absent: Chair Jill Larson-Vito and Commissioner Rob Rydberg Also Present: Councilmember/Liaison Mike Beyer Staff Present: Senior Planner Chris Leeseberg, and Sr. Admin. Assistant/Recording Secretary Jennifer Green 1. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments was called to order at 6:30 p.m. by Vice Chair Beise. 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Consider November 22, 2022, Board of Adjustments Agenda Moved by Commissioner Johnson and seconded by Commissioner Keisling to approve the November 22, 2022, Board of Adjustments agenda. Motion carried 5-0. 4. Consider October 25, 2022, Board of Adjustments Minutes Moved by Commissioner Johnson and seconded by Commissioner Booth to approve the September 27, 2022, Board of Adjustments minutes. Motion carried 5-0. 5.1 Elk River Lodge – 17432 Zane St. NW  Parking Variance allowing a reduced number of stalls and increasing rental units, Case No. V 22-14 Mr. Leeseberg presented the staff report. Vice Chair Beise noted the public hearing was still open. Board of Adjustments Minutes Page 2 November 22, 2022 ----------------------------- There being no one to speak, Vice Chair Beise continued the public hearing to December 20, 2022. 5.2 Paul Peterson – Fresno St. NW  Variance for a 10’ rear yard setback to construct a home, Case No. V 22-15 Mr. Leeseberg presented the staff report. Commissioner Maurer asked about the applicant wishing for a front yard setback. Mr. Leeseberg stated the applicant would prefer a larger rear yard. Commissioner Maurer asked if the driveway location would be something to discuss tonight or at a different time. Mr. Leeseberg indicated the driveway location would be part of the building permit process and would be reviewed by the city engineer. Vice Chair Beise opened the public hearing. Jim Hecker, 13196 Mississippi Road, indicated his property adjoins the applicant’s and asked for clarification regarding the setbacks from the 2018 meeting. His notes indicated the setback was 25’. He indicated he has no concerns with where the home is proposed but asked if staff could foresee there being any impacts to his property. Mr. Leeseberg indicated the information in the 2018 staff report was incorrect and should have referenced a 15’ setback. Mr. Leeseberg stated a shed can be placed 5’ from the property line. Staff doesn’t see any issues with future impacts. th Amy Banker, 13149 180 Avenue NW, expressed concerns about the location of the proposed driveway, explaining the traffic and pedestrians on the road makes it a precarious area already. Mr. Leeseberg indicated the owner of the lot would work with the city engineer during the building permit process to address the proper location of the driveway. There being no one else to speak, Vice Chair Beise closed the public hearing. Moved by Commissioner Johnson and seconded by Commissioner Keisling to approve the request by Paul Peterson for a variance for a 10’ rear yard setback to construct a home at 18094 Zane St. NW as all five of the criteria required for approval of the variance are met as outlined in the staff report.
