4.1 DRAFT MINUTES (1 SET) 01-17-2023 Meeting of the Elk River City Council Held at the Elk River City Hall Tuesday, January 3, 2023 Members Present: Mayor John Dietz, Councilmembers Mike Beyer, Cory Grupa, Matt Westgaard, and Jennifer Wagner Members Absent: None Staff Present: City Administrator Calvin Portner, Human Resources Manager Lauren Wipper, and Deputy City Clerk Jolene Richter 1. Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 6:32 p.m. by Mayor Dietz. 2. Pledge of Allegiance Pledge of Allegiance was recited. 3. Oath of Office Mayor Dietz and Councilmembers Grupa and Wagner took the oath of office before assuming their roles as Mayor and Councilmembers. 4. Consider Agenda Moved by Councilmember Westgaard and seconded by Councilmember Wagner to approve the agenda. Motion carried 5-0. 5. Consent Agenda Moved by Councilmember Grupa and seconded by Councilmember Westgaard to approve: 5.1 December 19, 2022, Regular Minutes. 5.2 Check register as outlined in the staff report. 5.3 Designate the use of the City of Elk River website, ElkRiverMN.gov as the location where transportation projects will be advertised. 5.4 Designate the Star News as the city’s official newspaper for legal notices. 5.5 Resolution 23-01 designating depositories of city funds and delegating authority for electronic funds transfers. 5.6 Appoint the Environmental Services and Special Projects Director position as the assistant weed inspector. City Council Minutes Page 2 January 3, 2023 ----------------------------- 5.7 Resolution 23-02 adopting the support for a 25% contribution local cost share for an Arvig Broadband Expansion Project. 5.8 Approve the updated position descriptions for assistant city administrator, finance manager, and recreation manager, as outlined in the staff report. 5.9 Approve a closed meeting for Tuesday, January 3, 2023, immediately following the City Council meeting at Elk River City Hall, 13065 Orono Parkway. 5.10 Amend contract #2022-24, the Republic Residential Hauler Service contract, to align with the rate schedule, as outlined in the staff report. 5.11 Resolution 23-03 amending and restating the city’s Flexible Benefits Plan effective January 1, 2023, as outlined in the staff report. 5.12 2023 Board of Appeal and Equalization meeting rescheduled for 6:00 p.m., Monday, April 10, 2023. Motion carried 5-0. 6. Open Forum No one appeared for Open Forum. 7. Presentations, Awards, and Recognition There were no presentations, awards, or recognition. 8. Public Hearings There were no public hearings. 9.1 Appoint Acting Mayor Mayor Dietz presented the staff report. Moved by Councilmember Wagner and seconded by Councilmember Beyer to appoint Councilmember Westgaard as acting Mayor for 2023. Motion carried 5-0. 9.2 Discuss Work Session Items There were no added work session items. 10. Work Session There was no work session. 12. Adjournment There being no further business, Mayor Dietz adjourned the meeting of the Elk River City Council at 6:44 p.m. Mayor Dietz stated the Council would be holding a closed meeting as permitted by Minnesota Statute, Section 13D.03 to discuss the city’s labor negotiation strategy related to the city’s negotiations with the Police Patrol Unit, LELS 231. 13. Motion Calling Closed Meeting Pursuant to due call and notice thereof, the closed meeting of the Elk River City Council was called to order at 6:50 p.m. by Mayor Dietz. Moved by Councilmember Beyer and seconded by Councilmember Westgaard to call the closed meeting. Motion carried 5-0. 13c. Hold Closed Meeting Council held a closed meeting pursuant to Minnesota Statue, Section 13D.03 to discuss the city’s labor negotiation strategy related to the city’s negotiations with the Police Patrol Unit, LELS 231. 13d. Motion Adjourning Closed Meeting Moved by Councilmember Westgaard and seconded by Councilmember Wagner to adjourn the closed meeting. Motion carried 5-0. 14. Adjournment Moved by Councilmember Beyer and seconded by Councilmember Grupa to reconvene regular meeting. Motion carried 5-0.
