RESOLUTION NO. 05 - 118
A RESOLUTION AMENDING THE COMPREHENSIVE PLAN
TO CHANGE THE LAND USE FROM OS (OPEN SPACE) TO
DR (URBAN RESIDENTIAL)
Case No. LU 05-07
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure
for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on Tuesday, September 27,
2005, and recommended approval regarding the Comprehensive Plan amendment request for the
property generally described as:
(See Attached Exhibit A)
and,
WHEREAS, the City Council has reviewed the Comprehensive Plan Land Use Map
Amendment request and finds the following:
1. The proposed changes are in general conformance to the adopted Comprehensive
Plan.
2. The proposed land use plan amendment will allow for Urban Residential use in an
area with compatible uses.
NOW, THEREFORE, BE IT RESOLVED by the Gty Council of the City of Elk River
that the Land Use Plan be amended to change the property as described above from OS (Open
Space) to UR (Urban Residential).
PASSED by the Gty Council of the Gty of Elk River this 17th day of October, 2005.

Exhibit A
The Southwest Quarter of the Northwest Quarter (SWIA of NWIA) of Section Two (2), Township
Thirty-two (32), Range Twenty-six (26), Sherburne County, Minnesota.
The Southeast Quarter of the Northwest Quarter of Section 2, Township 32 North, Range 26 West,
Sherburne County, Minnesota, EXCEPT that part thereof described as follows:

Southeasterly and Easterly a distance of 269.78 feet along a tangential curve concave to the Northeast
having a radius of 170.00 feet and a central angle of 90 degrees 55 minutes 36 seconds; thence South 89
degrees 38 minutes 23 seconds East, tangent to said curve, a distance of 111.57 feet; thence Easterly and
Southeasterly a distance of 69.74 feet along a tangential curve concave to the Southwest having a radius
