Garbage Fee
Staff reviewed the gaYbage fees and Yecommends the fee chaYged for the 32 gal bi-weekly caYt be adjusted to cover
the incYeased cost charged to the cityr by the HauleY. r1ll other cart sizes aYe priced coYYectly.
Environmental Fees
Staff revie`ved environmental fees and recommends amending the schedule to include escro`v fees for violations of
the Wetland Conservation Act to cover additional labor costs incurred while resolving violations.
Recreation Fees
The Parks and Recreation Commission recently reviewed fees foY shelteY rental and concession stand use
and is recommending changes as outlined in this report.

Background/Discussion
At the December 8, 2021, Parks and Recreation Commission meeting, Commissioners discussed and approved
updated athletic field use fees. With the implementation of these fees, we experienced greateY user accountabilityr
and actual usage.
The fee structure has been well-received by our associations with the only complaint being the daily charge for the
use of the concession stand. It was created as a dailyr rate in case of one-dayr tournaments. However, we are
learning that the tournaments we host in Elk River are multiple days and the organizers would prefer a lump fee.
Upon researching this further, we found that other cities are split equallyT on dailyT charges or per tournament.
Staff is recommending changing the concession stand fee from a dailyT fee to a per `veekend fee. The cityT will still
require a seasonal temporaryr food stand/special event license.
Financial Impact
There �vill be little to no monetaryT impact `vith this update.

Restroom Cleanings (Tournaments�

attendance estimates.
■ The associations will be billed at the same Yate as the cityr for the cleanings.
■ This fee will apply to the indoor restroom facilities and any additional portable toilets.
De�osit
■ All useYs/associations/tournament organizer will pay a$500, Yefundable deposit on an
annual basis/per tournament The refundable deposit will help ensure user/association
accountability for damage to fields, facilities and/or scoreboard controllers.
■ If the deposit is used foY any of the above-mentioned items, the user/association will
replenish their deposit back to the full amount of $500.
Fee Management
■ Cit�T will request enrollment data to invoice accordinglyT.
■ Field rental revenues will be allocated to the Park Improvement Fund to be utilized for
athletic field facilityT improvements.
Seasonal Tem�orary Food Stand/S�ecial Event License Rec�uirements
■ A license is required if yTou plan to sell food or beverages in Minnesota.

■ O�vners and operators of seasonal temporary food stands (STF) or special events must meet
licensing and food safetyr requirements to get their business/opeYations started. (See
attached fact sheet) This fact sheet `vill help �Tou understand the requirements and promotes
a safer operation of the STF/Special Event License and reduces the risk of foodborne
illness.

Background/Discussion
At the December 8, 2021, Parks and Recreation Commission meeting, Commissioners discussed and approved the
updated 2022 shelter and pavilion rental fees.
No`v that the pavilion is open at Orono Park, staff are noticing a trend `vith the rentals and are proposing
additional changes to what was approved in 2021.
Staff recommends changing the daily rate at Shelter #3 (next to the playground and the splash pad) from $60 to
$70 for residents and $100 for non-residents.
Staff also Yecommends the Yemoval of the damage deposit at the new Orono PaYk Pavilion. We have learned that
people aYe hesitant to rent this because of the up-fYont cost of the damage deposit when they can Yent Shelter #3
and not pay a damage deposit. By removing this Yefundable fee, the cityr would also save money on cYedit caYd
refunds and anticipate an increase in rentals.
Financial Impact
An expected increase in Yental Yevenue.

The goal of this change is to be proactive and adjust ouY fee structure based on trends documented by staff to
incYease Yentals and revenue.

The City Council of the CityT of Elk River does herebyT ordain as follows:
SECTION 1. That Ordinance 22-28 be amended by changing the fees as shown in Exhibit A.
SECTION 2. All other provisions of Ordinance 22-28 shall remain in full force and effect.
SECTION 3. That this ordinance shall take effect upon adoption.
