Background/Discussion
The Elk River Police Department, in conjunction with the Sherburne CountyT Health Department, conducts
compliance checks of all licensed tobacco establishments in the cityr at least twice a yeaY. The chart below outlines
the state law penalties along with the violation historyr for the Elk River Vape BaY, located at 13493 Business Center
Drive. In addition to t�vo compliance check failures in a 36-month period, the police depaYtment Yecently cited the
establishment for underage selling.

A Resolution Imposing Administrative Penalties for Violations of
Tobacco License Requirements
WHEREAS, the Elk River Vape Bar (Vape Bar) is licensed to sell tobacco and tobacco products
under Elk "River CityT Code � 26-67; and
WHEREAS, State Law, Elk River Cityr Code, and the conditions of the license held byr the Vape
Bar prohibit the sale of tobacco and tobacco products to persons under 21 yTears of age, and require
employTees at the Vape Bar to confirm the age of anyT person to ��hom theyT sell tobacco and tobacco
products. Elk River CityT Code � 26-33 holds the licensee responsible for the actions of its employTees
in regard to the sale of tobacco or tobacco products; and
WHEREAS, Elk River CityT Code � 26-35 authorizes the CityT to, from time to time, conduct
unannounced compliance checks at each location `vhere tobacco and tobacco products are sold; and
WHEREAS, on SeptembeY 15, 2020, the Elk RiveY Police DepaYtment conducted a compliance
check at the Vape Bar byT having a person under the age of 21 (a Compliance Minor) attempt to
purchase tobacco from the Vape Bar. The Vape Bar sold tobacco to the Compliance Minor despite
being under 21 yTears of age. The Vape Bar, and the employTee who sold the product, were cited at
the time of this violation and paid the citation; and
WHEREAS, on October 31, 2022, after YepoYts of suspicious activities, the Elk RiveY Police
apprehended a minor in possession of tobacco products. The minor stated that he had purchased
the tobacco pYoducts from the Vape BaY, which the minoY stated did not pYoperly identify the age of
potential customeYs as is required b�r lativ and its license. The minoY identified the employree tivho had
sold him the products. Elk River police officers then spoke with the emplo�Tee, who admitted to
selling the tobacco products to the minor; and
WHEREAS, on December 5, 2022, the Elk River Police Department conducted an unannounced
compliance check at the Vape Bar. The Vape Bar sold tobacco products to the Compliance Minor
despite that peYson being undeY the age of 21; and
WHEREAS,Elk River CityT Code � 26-73(a) states that anyT licensee who violates Cit�r Code and
the conditions of the license shall be subject to the admitustrative penalties set forth in Minn. Stat.
� 461.12. Minnesota Statutes � 461.12 states that foY a second violation �uithin a thirt�r-siY (36)
month period, the CityT shall impose an administrative penalt�T of $600. For a third violation `vithin a
thirtyr-siY (36) month period, Minnesota Statutes � 461.12 imposes an administrative penaltyr of
$1,000 and a seven (7) da�T license suspension; and

WHEREAS, Minn. Stat � 461.12 requires that no suspension, revocation, or other penaltyT ma�r
take effect until the licensee has received written notice of the alleged violation or violations, and has
had an opportunityT for a public hearing on the alleged violation; and
WHEREAS, on December 14, 2022, the Cityr of Elk River provided the Vape BaY written notice
of the alleged violations on October 31, 2022, and December 5, 2022. This written notice instructed
the Vape Bar that it had the right to Yequest a hearing. The Vape BaY requested a hearing on the
alleged violations, which the Cityr of Elk River held on Februaryr 6, 2023. The Vape Bar was
pYesented with a full and fair opportunityr to speak at this hearing.
NOW, THEREFORE, BE IT RESOLVED by the CityT Council of the Cit�T of Elk River,
Minnesota, as follows:
1. The Cityr Council Yeaffirms the recitals above and the factual findings therein and
incorporates them herein as of restated in full.
2. The Vape Bar has a prior violation of CityT Code and the conditions of its license that
occurYed on SeptembeY 15, 2020.
3. The Vape Bar violated CityT Code and the conditions of its license on October 31, 2022,
byT selling tobacco products to a person under the age of 21 and byT failing to properl�T
identif�r the age of its potential customeYs. The OctobeY 31, 2022 violation was the
second violation `vithin a 36-month period.
4. The Vape Bar violated CinT Code and the conditions of its license on December 5, 2022,
byT selling tobacco products to a person under the age of 21 and byT failing to properly
identifyr the age of its potential customers. The DecembeY 5, 2022 violation was the third
violation `vithin a 36-month period.
Having considered the full record before it, including the police reports of the violations
and the testimonyT of the Vape Bar, the CityT Council finds that there is nothing which
would justify depaYting from the pYesumptive penalt�r under Minn. Stat � 461.12. The
Vape BaY shall pay an admitustrative penalty of $1,600.00 ($600.00 foY the OctobeY 31,
2022 violation and $1,000.00 for the December 5, 2022 violation) and shall have its
license suspended for seven (7) da�Ts.

ofNewport ci��rettes ihat she had just purchased frnm a white rnale attendant in the vape bar. Sk�e described
him as a�+er 18 '�C1A and the t�nly attendant in the stnre lhat she saw. X7CXXX�CX stated that th� attendant
did ask h�r far her ID, but that he anly "glanced at it." I callecied the cigarett�s, later phatagraphed them, and
destroyed them at the ERPD.

Dear Anan:
On Monday, October 31, 2022, the Elk Rivex Police DepaYtment cited the Elk Rivex Vape
Bar for selling tobacco products to a person under the age of 21 years. Also on Monday,
December 5, 2022, the Elk River Police Departrnent, in conjunction with the Sherburne
County Health Department, conducted a tobacco compliance check of all licensed tobacco
holders in the City of Elk Rivex. During the compliance check at your establishment, an
employee sold a tobacco product to a peYson undex the age of 21 years.
This conduct is in violation of Minnesota Statute 461.12, Subd. 2—"Admuustrative penalty
for sales and futnishing; licensees" and Elk RiveY City Code. Pursuant to Muinesota Statute,
an administrative penalty is assessed to the licensee. The adinuustrarive penalty for both the
second and third violarion within 36 months of selling tobacco to a peYson undex the age of
21 yeaxs totals $1,600 and the license must be suspended for not less than seven days. If you
wish to appeal the imposition of these penalties, you can seek a hearing before the City
Council.
Indicate on the enclosed form your request of a hearing before the City Council, or if you
decide to waive the hearing, indicate that you are submitting payment of the adininistrative
penalty. If you decide to waive the hearing, the following penalties axe in effect:
$1,600 fine payable to the City of Elk RiveY
7-day suspension of tobacco license effective January 22 — 28, 2023. You must tuxn
in your license to the city during that time period.
Your hearing request or penalty payment must be received by Friday, January 13,

2020, the Elk River Police Department, in conjunction with the Sherburne County Health
Department, conducted a tobacco compliance check of all tobacco licensees in the City of Elk Rivex.
During the compliance check at Elk River Vape Bar, an employee sold tobacco to a person under the
age of 21 years. That letter was signed for on September 24, 2020.
According to the city ordinance, you are allowed the oppoxtunity of a hearing before the City Council
and were given 30 days from the date of the September 221etter to request this aduiinistrative
hearing or if you decided to waive the hearing to submit payment of the penalty ($300.00). To date,
the city has not received a request for a hearing or received payment of the penalty amount. The
