These are RECEIVING land use and not SOURCE standards. . The document includes the following sections: 1.Noise rules in Minnesota 2.Basics of how sound works 3.Measurement procedures 4.Minnesota noise pollution statutes and rules Another less widely used statue that has been used to assess noise is MERA ("Minnesota Environmental Rights Act") CHAPTER 116D. ENVIRONMENTAL POLICY Minnesota Statute 116B.02 Subd. 4. "Natural resources" shall include, but not be limited to, all mineral, animal, botanical, air, water, land, timber, soil, quietude, recreational and historical resources. Scenic and esthetic resources shall also be considered natural resources when owned by any governmental unit or agency. 3 The Noise Assessment Process 3.1 Noise Measurements a. Collect background noise levels at receptor sites b. Measure source noise levels to be used (if available) 3.2 Noise Predictions a. Use simple spreadsheets with sound propagation formulas b. Use computer models (proprietary models or internally developed models) 3.3 Determine compliance with Noise Standards a. Compare predicted project levels with the L10 and L50 state noise standards b. If levels exceed the L10 or L50 limits, go to 3.4 below. 3.4 Noise Control Measures (if needed or required) a. Noise source testing (e.g. MN DNR rules on off-road vehicle) b. Block sound paths (with enclosures, barriers or berms) c. SAE J1287 test procedure 8.2 Pre-emptive design Pre-emptive design can be very helpful in minimizing off-site sound levels. This might take the form of track layout with grading and/or berms or walls to shield sensitive off-site receptors from noise. Erection of additional berms or noise barriers at critical segments of track can be an effective method for shielding vehicle noise from potentially exposed and impacted receptor sites. These must be designed, however, to take the safety of drivers and spectators into account. 8.3 Noise monitoring options For track racing and off-road events - Spot sound level readings a selected locations - Remote data logging sound level meters at sensitive receptor sites For concerts - Set sound levels limits at the mix - Sound level monitors at the mix with green, yellow and red lights to show levels relative to an established limit - Off-site microphones connected to a concert sound level monitoring system 8.4 Permanent noise monitors Permanent sound level monitors at the property line and/or at selected sensitive locations in the neighbor may be helpful. Off-site monitors can provide sound level information for the facility as well as for city or state authorities to ensure compliance with sound level limits. 9 Summary The objective of a noise assessment is to demonstrate compliance with applicable noise standards at potentially impacted receptor sites including residential land uses and sensitive outdoor recreational land uses. The study requires an existing or proposed layout, information on noise sources at the facility, and noise source locations and time history. Pre-testing of vehicles and concert mix sound level limits, as well as berms or sound walls, may be needed to ensure compliance with noise standards.
