Dear Council Members:
Attached is a petition staff received from property owners in the ~aples Street/186m Avenue
neighborhood, requesting City sewer and water and permanent streets be constructed. Also
attached is an exhibit showing the properties that are represented by signatures on the
petition. As the City Council may be aware, the history of proposed improvements in this
neighborhood is very long, going back approximately 15 years. Previous City Councils have
looked at various options for building permanent streets and/ or extending City utilities into
the neighborhood. This petition is essentially asking the City Council to take another look at
a similar type improvement.
It should be noted that the City does not have all of the right-of-way needed for a street and
utility improvement, so part of any potential improvement project would be acquiring the
necessary right-of-way from those properties which have not given it to date. Attached for
the City Council's consideration is a resolution which declares the adequacy of the petition
and orders a feasibility report to analyze the extension of City utilities into the ~aples
Street/186th Avenue neighborhood.
If you have any questions regarding this issue, I will be in attendance at your ~ovember 21,
2005 City Council meeting.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DECLARING THE ADEQUACY OF THE
PETITION FOR IMPROVEMENT AND ORDERING THE
PRELIMINARY FEASIBILITY REPORT IN THE MATTER
OF THE NAPLES STREET AND 186th AVENUE IMPROVEMENT OF 2005
WHEREAS the City has received a petition (the Petition) requesting that the City improve certain
property by extending sanitary- sewer and water and constructing permanent streets
(the Improvement); and
WHEREAS the City has reviewed the petition and identified the owner of the real property
abutting the streets named in the Petition and determined the Petition has been duly
executed by the owners of not less than 35% in frontage of the real property
abutting on the streets named in the Petition as the location of the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. The Petition is hereby declared to have been signed by the owners of at least 35% of the
frontage of the real property abutting on the streets named in the petition as the location of
the improvement. This declaration is made in conformity to Minnesota Statutes, Section
429.035.
2. This Petition is hereby referred to Terry J. Maurer, City Engineer who is instructed to
provide to the City Council a report advising, in a preliminary- way, whether the proposed
improvement is feasible and whether the improvement should thus be made as proposed or
in connection with some other improvement and the estimated cost of the improvement as
recommended.
Passed and adopted this 21st day of November 2005.
