Request by Riverside Companies for Extension of Preliminary
Plat Approval for Hillside Estates 8th Addition

Overview
In March of 2001, the City Council approved the preliminary plat of Hillside Estates 8th
Addition; the preliminary plat included 99 single family lots. The final plat of Hillside Estates
8th Addition was approved in January 2002 and included 5 lots. In April 2003, the Council
approved Hillside Estates 9th Addition. This second phase of the project included 27 lots.
The third phase of the project, Hillside Estates 10th Addition, was approved in October
2003. This phase included 21 lots. In March 2004, the final plat of Hillside Estates 10th was
amended to revise some lot lines. Since that time, no activity has occurred regarding
additional final plats.
There are 46 lots remaining in the preliminary plat of Hillside Estates 8th Addition that have
to be final platted. The applicant is requesting an extension of the preliminary plat approval
for Hillside Estates 8th Addition. This will allow the developer to final plat the remaining lots
into the Eleventh and Twelfth Additions
Request
Section 30-374 of the City Code states that the
"failure of the subdivider to submit the final plat within one year unless a written
request for extension has been submitted and for good cause granted by the council,
shall cause the preliminary plat to become null and void. However, the subdivider
may continue to final plat a phase of the approved preliminary plat within one year

of each phase in order to extend valid approval of the preliminary plat. If all of the
phases of the approved preliminary plat are not finalized within a three-year period
from the date of council approval, the preliminary plat will become null and void
unless the subdivider requests and the council grants an extension."
As no final platting has occurred since October 2004, the applicant is requesting that the
Council allow an extension as noted in his letter to submit final plat for the remainder of the
Hillside Estates 8th Addition development without resubmitting for preliminary plat
approval.
Requested Action
The City Council is asked to consider the extension, and if it deems it appropriate, grant the
extension such that Riverside Companies may submit final plats for future additions of
Hillside Estates 8th Addition.
