4.4 Temporary On-Sale Liquor License for Elk RiverFest.
4.5 Temporary On-Sale Liquor License for Ruff Start Rescue.
4.6 The bid from JK Landscape Construction in the amount of $231,444 to stabilize
approximately 1,1101inear feet of riverbank on the Mississippi River in the William H.
Houlton Conservation Area (WHHCA) as outlined in the staff report.

the public hearing to the April 3, 2023, council meeting.
Moved by Councilmember Grupa and seconded by Councilmember Wagner to continue Item 7.1
regarding Conditional Use Permit: Vehicle Sales and Service for up to 11 Dealers at 17242 Ulysses
Street, Omar Alnuaimi to the Apri13, 2023, City Council meeting. Motion carried 4-0.
Conditional Use Permit: Construction of a Production Building Supporting Heavy
Manufacturing Operations at 1340 bth Street, Rinker Pipe.

Brian Olson, Rinker Materials, spoke on behalf of Rinker Materials. He addressed the actions Rinker
Materials is taking to fulfill the conditions listed on the Conditional Use Permit.
MayTor Dietz closed the public hearing.
Moved by Councilmember Wagner seconded by Councilmember Grupa to approve the Conditional
Use Permit with the following conditions to satisfy the standards set forth in Section 30-654:
1. All exterior building openings shall be closed when manufacturing operations occur within
a building prior to 6 a.m. and after 9 p.m. Monday through Sunday.
2. All vehicle back-up alarms shall be converted to a white-noise sryle by June 30, 2023.

3. The applicant shall submit a dust control plan for the operation prior to issuance of any
building permits.
4. The applicant shall submit documentation demonstrating compliance with state and federal
wellhead protection standards.
Motion carried 4-0.
Organization Business/Large Group Policy
Mr. Hecker and Ms. Larson presented the staff report.
Councilmember Wagner asked for clarification regarding �vhat �vould happen if other groups showed up
without a reservation. Ms. Larson explained that staff is frequentl�� contacted byT groups looking to reserve
use at the paYk and will explain the Large GYoup Polic�= and the reservation pYocess. The�r will post
Yeservarion signs on the shelteYs showing when the shelters are reser�red and by whom. She continued to
explain if someone just shows up they will not be guaranteed use of a shelteY, shelteYs not reserved can be
used on a first-come first-serve basis.
Moved by Councilmember Beyer and seconded by Councilmember Grupa to approve the
Organization Business/Large Group Policy. Motion carried 4-0.
Adjourn Regular Meeting
Moved by Councilmember Wagner and seconded by Councilmember Beyer to adjourn the regular
meeting of Ciry Council. Motion carried 4-0.

The Council provided the applicant with infoYmal, non-binding, feedback YegaYding the pYoposed
development pYoject and una.n.irnousl�r agreed that it was okay foY the applicant to move forwaYd with the
proposed plans.
10.2 Downtown Halloween
Mr. Hecker and Ms. Wingard presented the staff YepoYt.
Due to event growth and safety precautions the Council unanimously agYeed to close Main Street for the
Downtown Halloween event.
10.3 ERPD Wage Incentive Program Update

The Council reviewed and discussed updates to the ERPD Wage Incentive ProgYam as outlined in the staff
repoYt and agreed for staff to move forward with the proposed changes.
Staff will bring it back to the Council for final approval.
10.4 No Mow May Discussion
Mr. Portner pYesented the staff report.
The Council discussed the pYos and cons of No Mow Mayr as outlined in the staff repoYt and decided to take
no acrion this yeaY and to possiblyr revisit this topic in the future. The�r directed staff to seek feedback from
our communityT surveyT group.
10.5 Set Council Goal Setting Meeting Date

The Council discussed possibl�r eitheY Ma�� 8 or May 22 for their goal setting meeting.
CouncilmembeY Wagner added that she thinks moYe time should be allowed foY these meetings, to allow foY
more in-depth discussions.
MayoY Dietz stated the�� could start with the one meeting and then add another if needed.
The Council directed staff to move for�uard with Monday, MaST 8.
