Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 6:00
p.m. by Mayor Dietz.

Consider Agenda
Moved by Councilmember Wagner and seconded by Councilmember Beyer to approve the agenda.

Consent Agenda
Moved by Councilmember Beyer and seconded by Councilmember Grupa to approve:
4.1 March 6, 2023, Minutes.
4.2 Check register as outlined in the staff report.
4.3 Approve Resolution 23-13 approving a negative declaration of need for an environmental
impact statement for the Foster Property Development, as outlined in the staff report.
4.4 Temporary On -Sale Liquor License for Elk RiverFest.
4.5 Temporary On -Sale Liquor License for Ruff Start Rescue.
4.6 The bid from JK Landscape Construction in the amount of $231,444 to stabilize
approximately 1,110 linear feet of riverbank on the Mississippi River in the William H.
Houlton Conservation Area (WHHCA) as outlined in the staff report.
Motion carried 4-0.

Mayor Dietz presented the March Volunteer of the Month award to Gena Hahne. He highlighted the

7.1 Conditional Use Permit: Vehicle Sales and Service for up to I I Dealers at 17242 Ulysses

Mr. Carlton presented the staff report.
Mayor Dietz opened the public hearing. There being no one to speak on this issue, Mayor Dietz continued
the public hearing to the April 3, 2023, council meeting.
Moved by Councilmember Grupa and seconded by Councilmember Wagner to continue Item 7.1
regarding Conditional Use Permit: Vehicle Sales and Service for up to 11 Dealers at 17242 Ulysses
Street, Omar Alnuaimi to the April 3, 2023, City Council meeting. Motion carried 4-0.
7.2 Conditional Use Permit: Construction of a Production Building Supporting Heavy
Manufacturing Operations at 1340 6th Street, Rinker Pipe.
Mr. Carlton presented the staff report.
Mayor Dietz opened the public hearing.
Brian Olson, Rinker Materials, spoke on behalf of Rinker Materials. He addressed the actions Rinker
Materials is taking to fulfill the conditions listed on the Conditional Use Permit.
Mayor Dietz closed the public hearing.
Moved by Councilmember Wagner seconded by Councilmember Grupa to approve the Conditional
Use Permit with the following conditions to satisfy the standards set forth in Section 30-654:
1. All exterior building openings shall be closed when manufacturing operations occur within
a building prior to 6 a.m. and after 9 p.m. Monday through Sunday.
2. All vehicle back-up alarms shall be converted to a white -noise style by June 30, 2023.
3. The applicant shall submit a dust control plan for the operation prior to issuance of any
building permits.

4. The applicant shall submit documentation demonstrating compliance with state and federal
wellhead protection standards.
Motion carried 4-0.
8. Organization Business/Large Group Policy
Mr. Hecker and Ms. Larson presented the staff report.
Councilmember Wagner asked for clarification regarding what would happen if other groups showed up
without a reservation. Ms. Larson explained that staff is frequently contacted by groups looking to reserve
use at the park and will explain the Large Group Policy and the reservation process. They will post
reservation signs on the shelters showing when the shelters are reserved and by whom. She continued to
explain if someone just shows up they will not be guaranteed use of a shelter, shelters not reserved can be
used on a first -come first -serve basis.
Moved by Councilmember Beyer and seconded by Councilmember Grupa to approve the
Organization Business/Large Group Policy. Motion carried 4-0.
9. Adjourn Regular Meeting
Moved by Councilmember Wagner and seconded by Councilmember Beyer to adjourn the regular
meeting of City Council. Motion carried 4-0.
The regular meeting adjourned at 6:42 p.m. Mayor Dietz called the work session to order at 6:46 p.m.
10.1 Concept Review: BK Land Development, 13161 Highway 10, 9-Unit Residential
Subdivision
Mr. Carlton presented the staff report.
The Council provided the applicant with informal, non -binding, feedback regarding the proposed
development project and unanimously agreed that it was okay for the applicant to move forward with the
proposed plans.
10.2 Downtown Halloween
Mr. Hecker and Ms. Wingard presented the staff report.
Due to event growth and safety precautions the Council unanimously agreed to close Main Street for the
Downtown Halloween event.
10.3 ERPD Wage Incentive Program Update
Mr. Portner presented the staff report.

The Council reviewed and discussed updates to the ERPD Wage Incentive Program as outlined in the staff
report and agreed for staff to move forward with the proposed changes.
Staff will bring it back to the Council for final approval.
10.4 No Mow May Discussion
Mr. Portner presented the staff report.
The Council discussed the pros and cons of No Mow May as outlined in the staff report and decided to take
no action this year and to possibly revisit this topic in the future. They directed staff to seek feedback from
our community survey group.
10.5 Set Council Goal Setting Meeting Date
Mr. Portner presented the staff report.
The Council discussed possibly either May 8 or May 22 for their goal setting meeting.
Councilmember Wagner added that she thinks more time should be allowed for these meetings, to allow for
more in-depth discussions.
Mayor Dietz stated they could start with the one meeting and then add another if needed.
The Council directed staff to move forward with Monday, May 8.
11. Motion to Adjourn
Moved by Councilmember Grupa and seconded by Councilmember Wagner to adjourn the
meeting of City Council. Motion carried 4-0.
The meeting was adjourned at 7:35 p.m.
