Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 6:12
p.m. by Mayor Dietz.
2. Pledge of Allegiance:
Pledge of Allegiance was recited.
3. Consider Agenda
Mayor Dietz removed Item 4.7b and Item 4.8 from the agenda.
Moved by Councilmember Westgaard and seconded by Councilmember Grupa to approve the
agenda, as amended. Motion carried 5-0.
4. Consent Agenda
Moved by Councihnember Westgaard and seconded by Councilmember Beyer to approve, as
amended:
4.1 April 3, 2023, Special Meeting.
April 3, 2023, Regular Meeting.
April 10, 2023, Board of Appeal Meeting.
4.2 Check register as outlined in the staff report.
4.3 Bid from Perfection Plus in the amount of $109,525 for Custodial Services for Municipal
Buildings, a three-year period from May 1, 2023, through April 30, 2026, Agreement 2023-06.
4.4 Adopting Ordinance 23-05 changing PID #75-431-0270 address from 19476 Irving Street to
117471941h Avenue NW.
4.5 Adopting Ordinance 23-06 changing PID #75-410-0210 address from 507 Oxford Avenue to
1156 5`' Street NW.
4.6 Adopting Resolution 23-14 approving the Final Plat of The Villas at Filhnore Second
Addition with the following conditions:
1. A Development Agreement must be signed by the city and developer prior to
releasing the final plat for recording.
2. Park Dedication shall be paid in the amount required by the city when the final plat
is released for recording.

3. Water Availability Charge shall be paid in the amount required by the city when the
final plat is released for recording (currently $390/plumbing unit).
4. The Development Plan shall be approved by the public works director prior to
issuance of building permits.
5. Staff approval of all plans prior to releasing the plat for recording.
6. All mailboxes shall be clustered.
7. Any item or condition found that indicates the site is likely to yield information
important to pre -history or history shall be reported to the city immediately. Further,
the city reserves the right to stop work authorized in its approval until the site is
appropriately investigated and work is authorized.
4.7a Agreement 2023-07, a three-year ice purchase and facility use agreement with the MN
Squatch Junior A hockey team to utilize FT Center as their home venue.
4.7b Removed from agenda.

S. Open Forum
Jim Acres, Boy Scouts of America, invited councilmembers to a fundraiser.
6.1 City of Elk River Volunteer of the Month
Mayor Dietz presented the April Volunteer of the Month award to Sarah Soukup. He highlighted the
following:
■ Classroom volunteer at Otsego Elementary School.
■ Board member and past President of Elk River High School Lacrosse program.
■ Many hours to Thumbs Up organization.
■ Several volunteer activities at Twin Lake Elementary School.
■ Past secretary of Elk River Quarterback Club.
■ Supports Community Table program.
■ Newest member of the Elk River Library Board.
6.2a Oath of Office: Patrol Officers
Mayor Dietz stated he appreciates the work of the Police Department in keeping Elk River safe.
Police Chief Nierenhausen presented the staff report.
Mayor Dietz administered the oath to Officer Bailey Roscoe.

�7.1 Conditional Use Permit: Automobile Storage, Mike Jansons, I Ith Hour Recovery— 9672

Mr. Carlton presented the staff report.
Mayor Dietz opened the public hearing. There being no one to speak to this issue, Mayor .Dietz closed the
public hearing.
Moved by Councilmember Beyer and seconded by Councilmember Grupa to approve the
Conditional Use Permit authorizing automobile storage with the following conditions to satisfy the
standards set forth in Section 30-654:
1. The parking and driveway area outside of the fenced area shall be bound by B612 curb and
gutter.
2. All parking and driving areas must be finished with an approved surface — bituminous,
concrete, or compacted class 5.
3. The fence line parallel to the city street must be improved to include a 100% opaque covering.
4. All areas not identified for parking or driving areas shall be restored and maintained as turf
grass in accordance with city standards.
5. Outside of short-term staging requirements, there shall be no storage of vehicles outside of
the fenced area, to include the city street, exterior parking area, and landscaped areas.
6. This CUP only authorizes the storage of vehicles within the fenced area. Residential or office
uses are not authorized as part of this CUP.
7. All conditions of this CUP, including turf establishment, curbing, stormwater improvements,
and removal of all operations/parking outside of the fence, shall be completed by June 30,
2023.
8. Staff approval of all site and civil plans.
Motion carried 5-0.
8. General Business
There was no general business.
9. Adjourn Regular Meeting
Moved by Councilmember Westgaard and seconded by Councilmember Grupa to adjourn the
regular meeting of City Council. Motion carried 5-0.
The regular meeting adjourned at 6:29 p.m. Mayor Dietz called the work session to order at 6:32 p.m.
10.1 Concept Review: County Road 33/County Road I Residential Subdivision
Mr. Carlton presented the staff report.
Mayor Dietz asked how many lots would be one acre. Mr. Carlton responded around 25%. The size of the
lots depended on their location near wetlands and utility easement.

Mayor Dietz commented that the development would connect existing streets. Mr. Carlton stated Sherburr
County was in support of connecting these roads.
The Council liked the development plan as long as there are septic solutions for smaller lots. The project
will be reviewed by the Planning Commission.
10.2 Joint Meeting with Energy City Commission
Mr. Portner presented the staff report.
Energy City Commissioners Casey Mahon, Vern Iverson, and Levi Aesoph were in attendance.
Mr. Mahon gave a presentation on the progress of the Energy City Commission including defusing their
mission, voting for leadership, and identifying three goals to accomplish in 2023.
Mr. Wisner gave an update that an Eagle Scout will be working on installing the solar picnic table.
The Commission would like to develop a sign campaign that recognizes residents and businesses that
achieve certain levels of environmental sustainability. They will also be publishing four articles in the Star
Nesur on environmental issues.
The Commission stated the Elk River ElectriFUNcation and Test Drive Event will be held at the Furniture
and Things Community Event Center on August 5, 2023. They will also be present at the September 28,
2023, Elk River Farmer's Market.
10.3 Rolling Hills Sewer Extension
Mr. Wisner presented the staff report. He will be requesting bids for the Rolling Hills SSTS project. Rolling
Hills HOA representatives requested to view the final design and bids before staff recommends an option
to Council. Percentage rates and term lengths will be determined after the legislature has decided whether
they will be assisting the homeowners financially.
Mr. Wisner stated that the agreement will include 60 days for the contractor to hold their bid amount and
that all 28 homeowners must sign off on Petition and Waiver for project assessment.
10.4 Sanitary Sewer Ordinance Billing
Mr. Wisner presented the staff report. Elk River Municipal Utilities discovered that the current ordinance
has a senior citizen exception, however, their billing software does not have the capability to add birth date
information.
The item will return to the City Council as a public hearing for an ordinance amendment.
Council consensus to direct staff to remove the senior citizen exception from Ordinance Section 78-
187.
