Action Requested
Adopt, by motion, an ordinance adding motor vehicle sales as a permitted use in the I-3 (General Industrial)
zoning district.
Background/Discussion
Case No. OA 23-01 - The applicant has requested that motor vehicle sales be added as a permitted use in the I-3
(General Industrial) zoning district. The applicant notes that vehicle sales are permitted in the I-1 (Light Industrial)
and I-2 (Medium Industrial) as conditional uses and that the amendment would make the I-3 district, generally a
heavier use industrial district, consistent with the others.
Staff, in reviewing this request, also compared the request to the C-3, Highway Commercial, district where auto
sales are allowed as a permitted use. Similar uses in the I-3 district include motor vehicle storage (CUP), salvage
yards (CUP), and motor vehicle repair shops (permitted).
Amending the ordinance to allow motor vehicle sales as an allowed use rather than permitting with an Interim Use
Permit, or a Planned Unit Development project will allow the use on any parcel within the district. The I-3 district
is relatively compact and isolated in the southeast corner of the community and abuts commercial uses along
Highway 10, where auto sales and salvage yards are allowed.
Staff recommend amending the ordinance to allow motor vehicle sales as a permitted use, requiring administrative
review rather than a Conditional Use Permit, in the I-3 zoning district.
Planning Commission
The Commission reviewed the request during their April 24, 2023, regular meeting. No one spoke during the
public hearing, and we have not received any additional comments from the public. The Commission unanimously
recommended approval.

An Ordinance Amending Chapter, 30-1294, I-3 General Industrial District, of the
City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That � 30-1294 (b), Permitted Uses, of the City of Elk River Code of Ordinances
shall be amended to read as follows:
(b) Permitted uses. Permitted uses in the I-3 district are as follows:
(1) Bottling and distribution.
(2) Business offices.
(3) Manufacturing, light.
(4) Motor vehicle repair shops.
(5) Motor vehicle sales.
(56) Research and development facilities.
(67) Warehouse spaces.
(78) Wholesale businesses.
SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by
law.
