Action Requested
Receive public comments, and continue, by motion, the public hearing
to the July 25, 2023, Planning Commission meeting.
Background
The applicant is deciding if he should include his detached accessory
structure in his request and has asked for an extension to the review
process to investigate the building being commercial. He is also
working with his attorney to put together an action plan to address the
concerns of the neighbors.
Because of the requested extension, the city is extending the 60-day
timeline to August 24, 2023. The 60-day letter emailed to the applicant
is attached. The city expects the Planning Commission to now review
the Conditional Use permit on July 25, 2023, and the City Council on
August 7, 2023.

Dear Mr. and Mrs. Bye,
On April 26, 2023, the city received your completed Conditional Use Permit application to operate a
Home Occupation (Contractors Yard) located at the address listed above. As you know, State
Statute requires a decision by the City within 60 days of this application. The Statute also allows the
City to extend the timeline an additional 60 days if necessary.
Due to your ongoing conversations with your lawyer, the city is extending the 60-day timeline to
August 24, 2023. The city expects the Planning Commission to now review the Conditional Use
permit on July 25, 2023, and the City Council on August 21, 2023.
