SUBJECT: Approval of Agreement Between Sherburne County and the
City of Elk River of Local Equipment Plan, Terms for Operating
and Replacement Costs of AutoMark machines to meet the
Help America Vote Act (HAVA) requirements
ITEM
Authorize entering into an agreement with Sherburne County for voter election machines
for upcoming elections for individuals with disabilities.
BACKGROUND
The Minnesota State Legislature has appropriated $29,000,000 from the Help America Vote
Act account for Counties to purchase electronic voting systems equipped for individuals
with disabilities and for certain related operating expenses. Each county expends the funds
in accordance with a plan that must be created by a county working group.
On August 1, 2005, the City Council approved Resolution 05-80 approving the use of Help
America Vote Act (HA V A) monies at the local level.
Since then some slight changes have occurred with none affecting the City of Elk River but
dollar amount changes for other entities within Sherburne County (St. Cloud, City of Clear
Lake and Clear Lake Township). However, Sherburne County is asking that the Council
review this new information and authorize the Mayor to sign the agreement between
Sherburne County and the City of Elk River regarding the voter election machines, the
ES&S AutoMark Voter Assist Terminals.
ACTION REOUESTED
Motion to authorize the Mayor to enter into an agreement with Sherburne County regarding
the voter election machines, the ES&S AutoMark Voter Assist Terminals, to be used for
upcoming elections for individuals with disabilities.

by the Secretary of State.
A few changes are necessary to the Local Plan developed by our workgroup last summer.
Enclos"ed or attached is a copy ofthe Revised Local Equipment Plan for Using
Assistive V {]Iting Technology in Sherburne County Precincts. The main changes are
1. A smaller amount is included for the City of St. Cloud grant to purchase M1 00
Precinct Counters (but it is included in the first allocation); and 2. For the "combined
polling place" of City of Clear Lake and Clear Lake Township, the Secretary's most
recent interpn;:tation is that only one AutoMark machine is to be provided from the
HA V A Grant funds for a combined polling place.
Also included here are five spreadsheets required, as we were recently notified by the
Secretary onHate's Office, regarding use of the HA V A Grant. Please have your Board
or Councill:!~view the information. shrn the enclosed approval or authorize the
Clerk to Si2111 and forward a copy to my office as soon as possible.
I apologize for giving you such short notice. The Secretary of State process took much
longer than anticipated. Please contact me, if you have any questions. I am happy that so
many of you participated in the workgroup last summer, and that the plan is quite simple
compared to other counties because we already have the M1 00 equipment. Thank you

Approval of Local Equipment Plan. Terms for Operating and Replacement Costs
Agreement between Sherburne County and the
City of Elk River
As authorized at its December 19,2005 Meeting
The Elk River City Council did review and agrees to the terms of the Sherburne County
Local Equipment Plan for Using Assistive Voting Technology, whereby at least one
AutoMark machine will be furnished to each Town and City Polling Place for the Fall 2006
Elections; and that Sherburne County will have 2 backup AutoMark machines for purposes
of testing programs and to be dispatched to polling places on Election Day, as needed.
Sherburne County will store the AutoMark equipment at no cost to Cities and Townships
and will cover the cost of insurance for all equipment stored by the County.
Training on how to operate the equipment will be provided during the Summer of 2006 or
before any Federal or State Elections are held in 2006.
Transportation will be provided, at the discretion of the County Auditor. Sufficient
notification will be made to the Town, City or School District when it will be necessary for
the equipment to be picked up instead.
Programming and supplies (printer cartridges, etc.) will be paid by the County for Federal,
State and County Elections; and will be paid by the local government for its local elections,
or costs will be prorated for combined elections.
To maintain the integrity of the equipment, as it does for maintenance of the M100
equipment, Sherburne County will pay the continued maintenance costs for the AutoMark
equipment.
The cost of any replacement equipment will be the responsibility of the Townships and
Cities.
When necessary (after 2007), agreements for rental of the equipment by a School District for
School Elections will be between the Townships, Cities and School Board where the
Election must be held.

Local Equipment Plan for Using Assistive Voting
Technology in Sherburne County precincts
Sherburne County Precincts will have acquired MIOO Precinct ballot readers for use in all
precincts. The equipment will be used in all federal and state elections beginning in 2006.
As required by Minnesota Statute 204B.18, the Sherburne County Auditor/Treasurer and
Municipal and School Election Staff met at the Government Center in Elk River on June
27,2005 and July 25,2005 and prepared this plan to:
I) Indicate the procedures to implement AutoMark assistive voting
technology equipment for use by disabled voters in each polling
location.
A) AutoMark Equipment Acquisition
1. The County, after consultation with its municipal clerks,
will provide for the purchase of one AutoMarkvoting
machine for use by disabled voters for every polling
place, to be used in the 2006 primary and general
elections. Federal funds provided to the County will be
used to pay the initial cost of this equipment.
B) Storage of Auto Mark Assistive Voting Equipment.
1. The County agrees to store all assistive voting equipment
on behalf of the local municipalities. The County may
choose to deliver the machines to each municipality prior
to any election or the County .may require themunici-
palities and school districts to pickup the machines.
C) Programming of Auto Mark Equipment
1. The County agrees to coordinate programming with the
vendor for all races and questions at the even-numbered
year Fall Elections, and will charge the municipalities,
schools. and special districts for Local Election prorated
shares.
2. Municipalities, Schools and Special Districts are
responsible for programming their Local Elections (after
2007) unless a request is made by the Local Election

Administrator for the County to coordinate it. The cost of
programming Local Elections will be prorated to the
Municipalities, Schools and Special Districts.
D) Other Maintenance and Operating Costs Related to AutoMark
Equipment.
1. The county agrees to continue contracting and to pay the
cost of maintenance for the AutoMark assistive voting
equipment, after any available HA V A Grant funds for
this purpose have been used.
II) Define who is responsible for any capital or operating costs related
to election equipment not covered by federal money from the Help
America Vote Act (HA VA) account.
A) Items considered are as follows:
1. Backup units - 2 units will be kept at the County for
testing and Election-Day backup. The initial purchase
will be paid from the HA V A Grant funds, if possible.
2. Consumables - printer cartridges, etc. will be paid by the
County for Federal,. State and County elections; and will
be paid by the municipalities for Local elections (after
2007).
3. Programming.-will be paid by the County for Federal,
State and County rac.es and questions. Programming
costs willbe prorated for Local Election races and
questions (City, Town, School and Special Districts)'held
at the same time as Federal, State and County elections.
Costs of programming for.other Local elections will be
paid by the City, Town, School or Special District.
4. Storage - The County will store all AutoMark
equipment in a secure, climate-controlled, insured
facility, unless other arrangements are agreed upon.
5. Transportation - The County may choose to deliver the
machines to each Municipality prior to any election Or
the County may require the municipalities to pickup the
machines, with proper advance notice.

6. Training- Election Judges will be trained in the
operation of the assistive voting technology equipment at
the biennial Election Judge Training sessions or before
any 2006. Federal or State Elections.
7. Maintenance after warranty period, and repairs - The
County will pay the cost of maintenance contracts for the
equipment after all HA V A Grant funds are.expended.
8. Insurance - The County will pay the cost of insurance for
replacement of the equipment in case of fire or other
damage or destruction for all assistive voting technology
equipment while stored by the County.
III) Outline how the grants will be used.
A) County Plan for Vote Counting
1. Sherburne County uses the following vote counting
systems:
a. Precinct count machines
b. This plan includes uniform MI00 equipment used
by all precincts.
B) AutoMark equipment purchase for .each polling place (Town
and City) in Sherburne County

assistive voting technology equipment is not eligible for
reimbursement from HA V A Grant monies.
