The general purpose and intent of the ordinance are met. 2. The property has a land use of residential and the use is consistent with the Comprehensive Plan. 3. The proposed use is reasonable and is permitted in the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction. 5. The variance will not alter the essential character of the locality Background/Discussion The applicant, Travis Pike, is requesting an accessory structure size variance to allow construction of a 2,880 SF detached accessory structure. The property currently has an attached and detached garage, for a combined total of 2,218 SF of garage space. The proposed structure, along with the existing garage space, totals 5,098 SF, or 1,098 SF above the permitted garage area allowed under the ordinance. The property is 9.94 acres in size and located in the R1-a (Single Family Residential). Accessory structure sizes in this district are regulated by a Figure I /69 sliding scale based on lot size. The following chart provides the lot sizes and accessory structure size limits for the lot sizes near the subject site: 2.5 acres to < 5acres 3,000 SF of attached and detached garage space 5 acres to < 10 acres 4,000 SF of attached and detached garage space 10 acres to < 20 acres 8,000 SF of attached and detached garage space At 9.94 acres the subject site is permitted 4,000 SF, and is 0.06 acres below the next tier which would permit 8,000 SF of total garage space. Variances may be granted when the petitioner establishes that the variance satisfies all five of the criteria described below. The variance is: 1. Is in harmony with the general purpose and intent of the ordinance, and The intent of the accessory structure size limits is meant to maintain a community aesthetic and preserve open space in the city's residential areas. The proposed accessory structure size is within the parameters that are allowed on parcels just 0.06 acres (approx. 2,600 SF) larger than the subject site. The general observer would not notice the lot size difference and as such the proposed variance to exceed the accessory structure limit by 1,100 SF, but well below the limit afforded a 10-acre parcel. The variance is in harmony with the general purpose and intent of the ordinance. 2. Is consistent with the City of Elk River Comprehensive Plan. The subject site is guided for single-family residential uses and the proposed accessory structure variance would not alter that use. The variance is consistent with the Comprehensive Plan. Variances may be granted when the petitioner establishes that there are practical difficulties in complying with the zoning ordinance. Practical difficulties means that: 3. The petitioner proposes to use the property in a reasonable manner not permitted by the zoning ordinance; The property is 0.06 acres below the threshold needed to exceed the current garage space limit of 4,000 SF. Their request keeps the accessory structure limit well below the 10-acre threshold that they nearly meet, and the overall appearance of the structure and location would not create an unusual appearance for the area. The proposed variance is a reasonable use not permitted by the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction; and The applicant states that the 0.06 acres of land that the site would need to meet the 10-acre limit for additional garage space was dedicated to the adjacent parcel. While this cannot be verified, the parcel does abut the city/county boundaries and the jurisdictional limits may have created the situation where the plat was slightly below 10-acres. The proximity to the city/county limits is unique and is not a consequence of the petitioner. 5. The variance, if granted, will not alter the essential character of the locality. The site abuts numerous large lots, many of which have larger accessory structures. The variance would not alter the essential character of the locality. We are currently looking to place a pole barn on the south part of our property. This pole barn will be for the use of storage mostly. This will allow us to place an RV that will be on our property to be stored inside. Likewise, this will allow us to store trailers to include our boat and various lawn equipment inside. This will reduce the sustainable cost of waste by allowing us to not have to wrap the boat and cover the RV and will help to ensure the items stored in the pole barn will not be exposed to the elements during our 4 seasons in Minnesota. Our lot size is 9.94 acres. We are just under the 10 acres lot size to be allow the 8,000 sq ft. When the lot was purchased originally, it was supposed to be 10 acres but 0.06 acres needed to be used for a neighboring property layout so it was reduced to 9.94 acres. We still have a substantial portion of the property that is left wild and natural in addition to substantial buffer areas around the building to allow it to fit properly on the property and maintain aesthetics for the neighbors and community. Although we understand the existing regulations, we feel that we are 1). Close to the land size needed to have 10K feet of storage. 2). We are currently on a corner lot, so access to the pole barn will be available off of 218th Ave. Our use of that entrance will be minimal so will not affect neighborhood traffic but will allow easy access to the pole barn. 3). We are planning on putting this storage area in an area that is almost surrounded by trees. That will help minimize the view of the barn from the main road (See Exhibit 1). The new construction will be 36-foot by 64-foot with a 9-foot overhang, so 2,880 feet of storage space. This would put us at a total of just under 5100 SQ FT, which is much under the 8,000 SQ FT allowance for a 10 Acre lot. The plans for this shed are attached in exhibit 2. Attached in Exhibit 3 is the delineation paperwork, to include the approval from the Army Corps of Engineers changing the wetland delineation.
