Request by Prosource Technologies for a Zone Change and
Conditional Use Permit
Request
Consider a request by Prosource Technologies for a zone change to AT (Antenna Overlay)
and a conditional use permit for a wireless telecommunication tower and equipment pad.
60-Day Rule
In order to comply with the 60-day requirement, this item needs action by December 30,
2005.
Location
The property is located on Orono Parkway, behind the Public Safety Building and east of the
softball fields.

Overview
The applicant, on behalf of Nextel, is proposing to rezone an area of 50' X 50' to Antenna
Overlay and requesting a conditional use permit for a 150' tall antenna tower. The proposed
tower will be located on city property, and the city will be placing it's 850 meghertz
equipment on the tower. The area is part of a larger 12 acre parcel, which is developed as the
city softball complex. The surrounding property is zoned R1 c. The surrounding land uses
include the softball complex, Elk River City Hall complex and the Sherburne County
fairgrounds.
The Board of Adjustment granted the applicant's request for a variance to the tower setback
requirement. The variance allowed a setback of 50 feet instead of the required 150.
Rezoning
In order to construct the proposed tower, a rezoning to AT is required. This overlay district
was established to manage the placement of antenna towers and to ensure their proper
placement regarding health, safety and welfare of the community. The overlay district does
not change the underlying A 1 zoning district, all the uses allowed in the A 1 district will
continued to be allowed on land zoned AT.
In considering a rezoning request of this nature, consideration should be given to the
compatibility with surrounding land uses and whether the rezoning is necessary to provide
effective wireless telecommunication coverage for the city. The proposed rezoning is
compatible with the surrounding land uses. The applicant has shown that this site is
necessary to provide effective wireless coverage for the city. The rezoning is also consistent
with the Comprehensive Plan for the city.
Conditional Use Permit
Co-location Requirements
The applicant has looked at co-locating on other sites within the city. They found that there
are no acceptable co-location opportunities within one mile of the proposed site. The City
will be co-locating it's 850 megahertz equipment on the tower. At a height of 150 feet, the
tower will provide the opportunity for 1 additional carrier.
Construction Requirements
The applicant will comply with the construction requirements outlined in the ordinance.
Design Standards
The proposed tower will be a mono-pole with a flat gray galvanized steel finish which will
blend in with the sky. The communication equipment at the base of the tower will be located
in a small shelter. The exterior of the shelter will be face brick to match the exterior of the

Public Safety Building. The shelter will be screened from the ball fields by evergreens. The
tower and equipment will be enclosed with a 6 foot high chain link fence topped with 3
strands of barbed wire. Access will be provided from the rear parking area of the Public
Service Building by a 12 foot wide drive. The drive will be paved to match the parking lot.
Landscaping
Landscaping is proposed around the lease area. It should be concentrated on the north and
west sides to provide screening from the. softball fields.
Signs and Advertising
No signage or advertising are proposed.
Illumination
No lighting is proposed. A safety beacon will be located on top of the tower.
Standards for Issuance of a Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
1. Will not endanger, it!Jure or detrimentallY ciffect the use and e,!jqyment of other property in the
immediate viciniry or the public health, sqftry, morals, comfort, convenience or general we(fare of the
neighborhood or the ciry.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderlY development and improvement of surrounding vacant
property.
4. Will be served adequatelY f?y and will not adverselY ciffect essential public facilities and services
including streets, police and fire protection, drainage, refuse disposal, water and sewer rystems, parks
and schools; and will not, in particular, create trcifJic congestion or inteiference with trcifJic on
atfjacent and neighboring public thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will
be detrimental to a'!Y persons or property because of excessive trcifJic, noise, smoke, fumes, glare,
odors, dust or vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor
importance.
7. Will fullY complY with all other requirements of this Code, including a'!Y applicable requirements
and standards for the issuance of a license or permit to establish and operate the proposed use in the
ciry.
If denial of such a permit should occur, it shall accompany recommendations or
determinations by findings or a report stating how the proposed use does not comply with
the standards set forth in Section 30-654.

Plannin~ Commission Meetin~
At the Planning Commission meeting held on December 13th, no one spoke at the public
hearing. The applicant explained the engineering and design involved regarding the possible
collapse of the tower. The Commission voted 7:0 to recommend approval of the zone
change and conditional use permit.
Recommendation
Rezoning
The Planning Commission and staff recommend that the City Council approve the proposed
rezoning request to AT based on the following findings:
1. The proposed rezoning is compatible with the surrounding land uses.
2. The proposed rezoning is necessary in order to provide effective wireless
telecommunication coverage for the city.
3. The rezoning is in accordance with the Comprehensive Plan for the city.
Conditional Use Permit
The Planning Commission and staff recommend that the City Council approve the
conditional use permit for a 150 foot tall wireless tower and supporting equipment facility
based on the finding that it complies with the standards found in Section 30-654 and with
the following conditions:
1. The applicant and the City enter into a lease agreement outlining the terms and
conditions of the tower construction, operation, access and maintenance.
2. The exterior of the shelter shall match the exterior of the Public Safety Building.
3. The site shall be screened from the softball fields with plantings. The proposed
evergreens shall be planted on the west and north sides of the fenced area
4. The access drive shall be paved

RE: Conditional Use Permit (CUP) Application
Nextel Communications - Proposed Cell Tower Construction
Dear Mr. Harlicker:
Nextel Communications (Nextel) is proposing to construct a cell tower in the City of Elk River,
MN. The location of the proposed tower is on City owned property located at 13065 Orono
Parkway, Elk River, MN 55330. Nextel is currently working with the City of Elk River on a
lease agreement. Please note that the CUP Application requires that the landowner sign the
form under "Owner Information". Please have the appropriate city official sign the application
form.
This proposed project will involve construction of a 150 ft monopole (no guy wires) cell tower,
as well as a 12 foot x 20 foot equipment shelter at the base of the tower. The proposed fenced-
in area will be approximately 50 feet x 50 feet. Attached is the completed Conditional Use
Permit Application, including site plans and maps. Checks have been ordered from
Nextel and will be submitted to the City of Elk River when we receive them.

CITY OF ELK RIVER
AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTIES
TO AT (ANTENNA OVERLAY)
CASE NO. ZC 05- 06
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone to AT the properties described as:
See Attached Exhibit A
Section 2.
The rezoning is being approved based on the following findings:
1. THE PROPOSED REZONING IS COMPATIBLE WITH THE
SURROUNDING LAND USES.
2. THE PROPOSED REZONING IS NECESSARY IN ORDER TO PROVIDE
EFFECTIVE WIRELESS TELECOMMUNICATION COVERAGE FOR THE
CITY.
3. THE REZONING IS IN ACCORDANCE WITH THE COMPREHENSIVE
PLAN FOR THE CITY.
Section 3. That this Ordinance shall take effect and be in full force from and
after the date of its publication.
Passed and adopted this 19th day of December, 2005, by the City Council of the City
of Elk River.
