regulate special use vehicles.
Background/Discussion
Chief Nierenhausen is attempting to close a loophole in the state law, which doesn't prohibit these types of
vehicles under certain circumstances.

An Ordinance Amending Chapter 74 - TRAFFIC AND VEHICLES, of The City of
Elk River, Minnesota, City Code to Regulate Special Use Vehicles
The CityT Council of the CityT of Elk River does herebyT ordain as follows:
SECTION 1. That Chapter 74 - TRAFFIC AND VEHICLES of the Cit�T of Elk River Code of
Ordinances is amended to add a new rlrticle VII to read as follo`vs:
ARTICLE VII. - SPECIAL USE VEHICLES
Sec. 75-185. - Defnitions.
The following woYds, teYms and phrases, when used in this article shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
ElectTzcpe�:sonal assistive 1nol�ility device has the same meaning given by Minn. Stat � 169.011, subd.
26a.
Mini-t�z�ck has the same meaning given by Minn. Stat � 169.011, subd. 40a.
Special use vehicle means a motorized golf cart, utility task vehicle, rniui-truck, go-cart, rniui-bike,
dune buggy, or other similar self-propelled vehicle, except that it does not include electric personal
assistive mobilityT devices, or a recreational motor vehicle or snowmobile as defined in sec. 74-181.
Utility task vehicle has the same meaning given by Minn. Stat � 169.045, subd. 1(3).
Sec. 75-186. - Operation on Public Properry Prohibited
No peYson shall opeYate, oY peYmit a person undeY the age of 18 yeaYs to opeYate, a special use
vehicle on highwayTs, streets, alleyTs, sidewalks, paths or other public propertyT designed for vehicular
or pedestrian traffic.
Sec. 75-187. - Penalry.
An�T person violating anyT provision of this article shall be guiltyT of a misdemeanor.
SECTION 2. That this oYdinance shall take effect upon adoption and be published as provided by
law.
