I . Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments was called to
order at 6:30 p.m. by Chair Larson -Vito.
2. Pledge of Allegiance:
The Pledge of Allegiance was recited.
3. Consider Agenda
Moved by Commissioner Beise and seconded by Commissioner Booth to approve the July 25, 2023,
Board of Adjustments agenda as presented.
Motion carried 5-0.
4. Consider Minutes
Moved by Commissioner Keisling and seconded by Commissioner Mauren to approve the June 27,
2023, Board of Adjustments minutes.
Motion carried 5-0.
5.1 The Cove — 13161 US Highway 10
■ Front Yard, Side Yard, and Property Width Setback Variances, Case No. V 23-06
Mr. Leeseberg presented the staff report.
Chair Larson -Vito opened the public hearing.
There being no one to speak, Chair Larson -Vito closed the public hearing.
Moved by Commissioner Keisling and seconded by Commissioner Beise to approve the Front
Yard, Side Yard, and Property Width Setback Variance (reducing the front -yard setback to 25-feet,
modifying the side -yard setback to be 7.5-feet, and reducing the minimum lot width to 66-feet) for
the following reasons:
1. The general purpose and intent of the ordinance are met.

2. The property has a land use of residential and the use is consistent with the Comprehensive
Plan.
3. The proposed use is reasonable and is permitted in the zoning ordinance.
4. The plight of the petitioner is due to circumstances unique to the property not a consequence
of the petitioner's own action or inaction.
5. The variance will not alter the essential character of the locality.
Motion carried 5-0.
6. Motion to Adjourn Regular Meeting
Moved by Commissioner Beise and seconded by Commissioner Keisling to adjourn the meeting of
the Board of Adjustments.
Motion carried 5-0.
The meeting was adjourned at 6:34 p.m.
