An Ordinance Amending Chapter 74 - TRAFFIC AND VEHICLES, of The City of
Elk River, Minnesota, City Code to Regulate Special Use Vehicles
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That Chapter 74 - TRAFFIC AND VEHICLES of the City of Elk River Code of
Ordinances is amended to add a new Article VII to read as follows:
ARTICLE VII. - SPECIAL USE VEHICLES
Sec. 74-185. - Definitions.
The following words, terms and phrases, when used in this article shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Electricpersonal assistive mobility device has the same meaning given by Minn. Stat. § 169.011, subd.
26a.
Mini -truck has the same meaning given by Minn. Stat. § 169.011, subd. 40a.
Special use vehicle means a motorized golf cart, utility task vehicle, mini -truck, go-cart, mini -bike,
dune buggy, or other similar self-propelled vehicle, except that it does not include electric personal
r assistive mobility devices, or a recreational motor vehicle or snowmobile as defined in sec. 74-181.
Utility task vehicle has the same meaning given by Minn. Stat. 5 169.045, subd. 1(3).
Sec. 74-186. - Operation on Public Property Prohibited
No person shall operate, or permit a person under the age of 18 years to operate, a special use
vehicle on highways, streets, alleys, sidewalks, paths or other public property designed for vehicular
or pedestrian traffic.
Sec. 74-187. - Penalty.
Any person violating any provision of this article shall be guilty of a misdemeanor.
SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by
law.
