3.5. SR 01-09-2006 *Item 3.5.* MEMORANDUM TO: Mayor and City Council FROM: Joan Schmidt, City Clerk DATE: January 9, 2006 SUBJECT: Approval of a Resolution Appointing Responsible Authority regarding Data Practices Minnesota Statutes, section 13.02, subdivision 16, requires that the City appoint by name, not position, a Responsible Authority to administer the City's Data Practices policy. The Council approved a resolution at the Council meeting of June 30, 1997 naming City Administrator Pat Klaers as the Responsible Authority and he held that position until his resignation. Since Lori Johnson is the new City Administrator the Council may wish to appoint her as the Responsible Authority. ACTION REQUESTED The Council is asked to approve the attached resolution appointing City Administrator Lori Johnson as the Responsible Authority for the data practices act. RESOLUTION NO. 06- RESOLUTION APPOINTING RESPONSIBLE AUTHORITY FOR PURPOSES OF THE MINNESOTA GOVERNMENT DATA PRACTICES ACT WHEREAS, MinnesQta Statutes, section 13.02, subdivision 16, as amended, requires that the City of Elk River appoint one person as the Responsible Authority to administer the requirements for collection, storage, use and dissemination of data on individuals, within the City; and WHEREAS, the City of Elk River shares the concern expressed by the legislature on the responsible use of all City data and wishes to satisfy this concern by appointing an administratively qualified Responsible Authority as required under the statue; and WHEREAS, the duties of Responsible Authority have in the past been performed by the city administrator; and WHEREAS, effective December 19, 2005, Lori Johnson was appointed the city administrator of the City; NOW, THEREFORE, BE IT RESOLVED: 1. The City Council of the City of Elk River appoints Lori Johnson as Responsible Authority for the purposes of meeting all requirements of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13, as amended, and the rules lawfully promulgated by the Commissioner of Administration at Minnesota Rules, Chapter 1205. 2. Ms. Johnson is authorized to delegate the duties of the Responsible Authority to other City employees as Ms. Johnson, in her discretion, determines to be necessary in order to satisfy the requirements of the Minnesota Government Data Practices Act and at the same time continue to effectively and efficiently provide other City services. 3.
