Christopher johnson, City Prosecuting Attorney TO: DATE: january 9, 2006 SUBJECT: International Property Maintenance Code (IPMC) Attached for your consideration is a proposed ordinance to adopt by reference the most current and future revisions of the International Properry Maintenance Code. This memo provides information regarding the intent and purpose of the proposed ordinance and the code it will adopt. The International Properry Maintenance Code (IPMC) contains uniform standards, regulations, and requirements for existing residential and non-residential structures. The code has been adopted by governing bodies throughout the United States. We believe the IPMC provides an approach that is compatible with the needs of the city as the code provides strong enforcement mechanisms and a streamlined approach to requirements that fit neatly with provisions of the International Building Code. The current Housing Standards for the City of Elk River are contained in Article III, Chapter 30 of the Elk River City Code. The IPMC will be adopted by reference using the language provided by the code itself, and will be located under Article III as Division 1A. Section 30-159 was added to allow the IPMC to co-exist with the current Elk River City Code. Our intent is that the IPMC will parallel existing City provisions until a time when decisions can be made about which provisions of the City Code should be repealed and which provisions should be retained. Adopting the International Properry Maintenance Code by reference allows the City of Elk River to use the existing City Code and the IPMC to custom design a set of property maintenance provisions. The ideal result is an integrated code based mostly on the International Code, but supplemented with useful provisions of the City Code. We have reviewed the text of Division 1A and respectfully request your approval of the adoption by reference of the International Properry Maintenance Code to become part of the Property Maintenance Code of the City of Elk River. Action Requested The Mayor and Council are asked to adopt Ordinance 06-_ adding Sections 30-157 through Sections 30-159 to the City of Elk River Code of Ordinances. ORDINANCE 06-_ CITY OF ELK RIVER AN ORDINANCE OF THE CITY OF ELK RIVER ADDING SECTIONS 30-157 THROUGH SECTIONS 30-159 TO THE CITY OF ELK RIVER CODE OF ORDINANCES The City Council of the City of Elk River does hereby ordain as follows: ARTICLE III, CHAPTER 30 Division lA. International Property Maintenance Code Section 30-157: That a certain document, the most current copy of the International Proper[y Maintenance Code, three (3) copies of which are on file in the office of the City Clerk of the City of Elk River, being marked and designated as the International Proper[y Maintenance Code as published by the International Code Council, Inc., is adopted as the Proper[y Maintenance Code of the City of Elk River, in the State of Minnesota; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Proper[y Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in section 30-158 of this ordinance. Any future revisions of the International Proper[y Maintenance Code will always be part of the Property Maintenance Code of the City of Elk River. Section 30-158: The following sections of the International Proper[y Maintenance Code are hereby revised: Section 101.1. Insert: City of Elk River Section 103.6. Insert: The current year fee schedule adopted by the City Council Section 303.14. Insert: January to December Section 602.3. Insert: October 15 to April 15 Section 602.4. Insert: October 15 to April 15 Section 30-159: Where there is any conflict between the provisions of the International Proper[y Maintenance Code and any other applicable code or ordinance enforced by or in the City of Elk River, the more restrictive provisions shall apply. Passed and adopted by the City Council of the City of Elk River this 9th day of January, 2006. This Ordinance shall take effect upon publication as provided by law.
