2. A 35-foot-wide trail easement along KlieveY MaYsh above the
OrdinaryT High-Water Mark shall be provided.
Background/Discussion
The subject propeYty is 5.64 acYes, zoned R1-c, and located at the end of
Johnson Court in the Park Point Subdivision. The applicant is requesting
to replat Outlot A of Park Pointe into one buildable lot and one Outlot.
The one buildable lot will connect to the e�sting Johnson Court cul-de-sac
on the east side of the parcel and abuts Kleiver MaYsh on the west side.
Parks and Recreation Commission
The Commission recommends cash dedication for one dwelling unit at the
rate applicable when the subdivision is released for recording. TheyT also
Yecommend a 35-foot-wide trail easement along Kliever Marsh as indicated
in the Trails MasteY Plan. The setback foY the trail should follow the
OrdinaryT High-Water Mark.

The propertyT is zoned R1-c and meets all dimensional requirements and is consistent with all zoning
regulations.

I�ut not li�nited to, tbe czty's co�nprehensive �levelopynentplan.
The property is guided single-family residential, and the subdivision is consistent with all applicable plans.

The physical characteristics of the site are suitable for the type and density of development (one parcel)
and uses contemplated.

Services, facilities, and improvements are currently located in Johnson Court.

Although there may be site grading and tree removal in support of a ne`v single-famil�T home, the
subdivision �vill not cause substantial environmental damage. Construction activities will also need to
complyT `vith the setback requirements for building around Kleiver Lake.

A Resolution of the City Council of the City of Elk River Granting Final Plat
Approval for Park Pointe Second Addition, Case No. P 23- I I
WHEREAS, application has been made foY final plat approval, pursuant to Section 30-391
of the Elk RiveY City Code of OYdinances, of the pYopeYt�r legally described on attached
Exhibit A and hereinafter referred to as "the PropertyT"; and
WHEREAS, the proposed final plat complies with each of the conditions set forth byT the
Cit�r Council in its approval of the plat of the Property.
NOW, THEREFORE, BE IT RESOLVED b�T the CityT Council of the CityT of Elk
River, Minnesota, as follo�us:
A. The proposed subdivision is consistent `vith Chapter 30 of the CityT Code of
Ordinances and conforms with all its requirements.
B. The proposed subdivision is consistent `vith all applicable general and specialized
cityT, countyT, and regional plans including, but not limited to, the city's
Comprehensive Plan.
C. The phyTsical characteristics of the site, including, but not limited to, topography,
soils, vegetation, susceptibilityT to erosion and siltation, susceptibilityT to flooding, and
drainage are suitable for the tyTpe and densit�T of development and uses contemplated.
D. The proposed subdivision makes adequate provision for `vater supplyT, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.
E. The proposed subdivision `vill not cause substantial environmental damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.

Final plat approval is herebyT granted for the PropertyT.
2. The officers of the Cityr aYe hereby authorized, once the conditions set forth in E�ibit B
are met and complied with, to sign the final plat for the Propert�r and to issue a certified
copyT of this Resolution giving final approval of the plat.
3. The o�vner of the PropertyT is authorized to record the final plat as required byT law and
shall file proof of said recording `vith the City. No building permits `vill be issued for the
PYopeYtyr until the final plat is YecoYded.
4. This final plat approval shall expire two �rears from the date of this Yesolution if the
final plat is not recorded �vithin that time.
