Background/Discussion
Section 78-43 of the cityT ordinance authorizes the cityT to levyT an assessment against propertyT for any unpaid
`vater utilityT fees as of September 30.
Section 78-332 of the cit�r oYdinance authorizes the cit�r to levyr an assessment against pYopeYt�r foY an unpaid
electric service fees 30 days past due.
All propertyT owners who had delinquent utilit�T fees have received notice informing them that the�T would be
assessed unless the account was bYought cuYrent.
Attached are the assessment lists of pYopeYties with delinquent utilities: Water -$2,183.29 and Electric -
$4,855.47. The assessment total for 2023 is $7,038.76 and the total in 2022 was $5,414.81.

Resolution 23-
A Resolution of the City Council of the City of Elk River Levying Assessment
for Unpaid Water Utility Services
WHEREAS, Minnesota Statutes Section 444.075 authorizes the cit�r to annually levyr an
assessment equal to such unpaid charges for `vater utility services as of September 30 each
year; and
WHEREAS, the cittT ordinance Section 78-43 authorizes the cityT to levyT an assessment
against propeYtyr foY wateY utilityr services equal to the unpaid chaYges as of SeptembeY 30;
and
WHEREAS, all customers and property o`vners with delinquent balances have been given
adequate notice of this pending assessment and have been given opportunities to payT prior
to this assessment being levied; and
WHEREAS, state la`v does not require a public hearing or notice before le��yTing such
assessments.
NOW, THEREFORE, BE IT RESOLVED byT the CityT Council of the CityT of Elk
River, Minnesota, as follows: The parcels and amounts listed in attached Exhibit A are
coYYect and made a paYt heYeof, and are to be levied and ceYtified to the SheYbuYne Countyr
Auditor.

WHEREAS, Minnesota Statutes Section 366.012 authorizes the cit�r to ceYtifyr unpaid
chaYges to the count�r auditoY with taxes against the pYopeYtyr served foY collection as otheY
taxes are collected; and
WHEREAS, the cittT ordinance Section 78-332 authorizes the cityT to levyT an assessment
against propeYtyr foY electric service fees equal to the unpaid chaYges 30 days past due; and
WHEREAS, all customers and propert�- owners �vith unpaid balances 30 dayTs past due
have been given adequate notice of this pending assessment and have been given
opportunities to pay prior to this assessment being levied; and
WHEREAS, state law does not require a public hearing oY notice befoYe levyring such
assessments.
NOW, THEREFORE, BE IT RESOLVED byT the CityT Council of the CityT of Elk
River, Minnesota, as follows: The parcels and amounts listed in attached Exhibit B are
correct and made a part hereof, and are to be levied and certified to the Sherburne CountyT
Auditor.
