Zone Change from Planned Unit Development
(PUD) to I-3 General Industrial, Case No. ZC 23-07
Action Requested
Recommend, by motion, an ordinance to rezone certain property from
PUD to I-3 for the following reasons:
1. The rezoning is consistent with the City of Elk River Land Use
Plan adopted as part of the City of Elk River Comprehensive
Plan.
Background/Discussion
The property is zoned Planned Unit Development (PUD), and the
property owner is seeking to rezone the subject property to I-3 General
Industrial to facilitate a Conditional Use Permit (CU 23-23) to allow for
a tenant to operate a salvage yard.
The subject property is 2.12 acres in size and located east of Jarvis
Street south of the railroad tracks. It is surrounded by I-3 zoned
properties and two others zoned PUD. The proposed zone change is
consistent with the industrial nature of the area.
The attached document shows the uses that would no longer be
allowed, as well as additional uses that would be allowed, with the zone
change.

Comprehensive Plan
The Comprehensive Plan guides the property as industrial which includes both heavy and light industrial
businesses such as manufacturing, warehousing, and excavation. These uses are primarily located off Highway 169,
Highway 10, and the BNSF Railroad which provide easy access for the transferring of goods throughout the
region.
The proposed zone change will be consistent with the Comprehensive Plan.

Applicable Regulation
In reviening a proposed amendment, consideration shall be given to existing conditions avithin the area directly and indirectly affected
by the proposal, the conservation of properly values, the use to n.,hich the property affected is being devoted at the time, and relevant
provisions, if any, in the land use plan.
Staff do not believe there will be negative impacts to the road network, public utilities, or future park needs
because of the requested zone change. The proposed zone change is consistent with the zoning of the
surrounding parcels.
In the review of the standards for a Zone Change as outlined, it appears that the request is consistent with all of
these standards.
