The general purpose and intent of the ordinance are met. 2. The property has a land use of residential and the use is consistent with the Comprehensive Plan. 3. The proposed use is reasonable and is permitted in the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property, not a consequence of the petitioner’s own action or inaction. 5. The variance will not alter the essential character of the locality. Background/Discussion The applicant, Jeremiah Shank, has requested a setback variance from the Elk River. The subject site is located within the city’s shoreland management district, which includes additional standards for properties located along critical environmental features, like the Elk River. Sec. 30-2024 of the city ordinance regulates placement of roads, driveways, and parking areas within this district. The required setback for a driveway within the shoreland district is 100 feet from the ordinary high-water level for an unsewered lot. The applicant has constructed a driveway approximately 65 feet from the Elk River, and requires a 35-foot variance to maintain this driveway. The applicant has been working with the city’s environmental consultant, WSB, on the review and standards for the driveway. The representative from WSB supported the variance provided the applicant construct a berm and depressions to slow the water leaving the site. These improvements will reduce erosion and sedimentation to ensure the intent of the environmental regulations are satisfied. These improvements have been completed and photographs of the completed work are included as an attachment. Second, ordinance limits the driveway width for parcels in the R-1b zoning district to 30-feet in width. The applicant had two existing driveways, a looped driveway, which was a legal non-conforming use. The property is 3.48 acres in size and is a corner lot without city services. Updated: January 2023 minimum lot size of 2.5 acres (less than the applicant’s) and are permitted two driveway connections along with a total combined with of 40-feet. The new driveway exceeds the width allowed in the R-1b district and relocated the existing second driveway, which has now been removed. The purpose of the relocation was to improve safety and circulation. The remaining existing driveway is very close to the intersection with Highway 10 and does not support safe vehicle stacking and access to Yankton Street. The newly constructed second driveway provides space to safely turn around a vehicle out of the public right-of-way and access the public street. Applicable Regulation (The applicant’s responses are noted in italics) Variances may be granted when the petitioner establishes that the variance satisfies all five of the criteria described below. The variance is: 1. Is in harmony with the general purpose and intent of the ordinance, and The new driveway is within limits of river and has concern of river protection. New driveway and areas to change do assist in slowing the speed of the natural water path with areas next to roadway to slow and absorb as much as possible using multiple methods. The increased setback from a critical environmental feature, like the Elk River, is intended to protect the waterbody from further contamination. The setback provides space for water to slow down, reducing sedimentation, and allowing contaminants to filter out before reaching the river. The driveway width limit was established to preserve on-street parking, reduce impervious surfaces, and establish consistency in urban residential areas. The property has nearly 175 feet of useable frontage along Yankton and the lot size is larger than a rural residential lot. The size and location of the lot maintains the general purpose and intent of the ordinance after accounting for the increased width. Additionally, having completed the mitigation measures recommended by the city’s environmental consultant, the variance is in harmony with the general purpose and intent of the ordinance as it relates to the Elk River. 2. Is consistent with the City of Elk River Comprehensive Plan. I have met with and reviewed the plan with the city’s environmental consultant. She (Rebecca) has recommended the addition of some depressions, vegetation, and a berm to assist with slowing of the water in its natural path. The Comprehensive Plan has a clear focus on protecting the unique and varied environmental features of the community. The applicant has been working closely with city representatives to ensure these features are protected. The property is also guided for single-family residential uses and the additional driveway width will not impact the use. The variance is consistent with the Comprehensive Plan. Variances may be granted when the petitioner establishes that there are practical difficulties in complying with the zoning ordinance. Practical difficulties means that: 3. The petitioner proposes to use the property in a reasonable manner not permitted by the zoning ordinance; Yes. Request is a driveway and will be used as such. The proposed driveway location near the Elk River and the additional width will not detrimentally impact the zoning district, surrounding properties, or critical environmental features. The proposed variance is a reasonable use not permitted by the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction; and nd Yes. The 2 driveway is too steep and has caused damage to vehicles and is unusable in the winter to all but 4x4 vehicles. This is due to the natural elevations of the native landscape and the roadway and was this way when I bought the house. The location of the lot, the topography of the parcel, and access to a public street are unique situations generally not seen elsewhere in the community. These unique features pushed the driveway closer to the Elk River while also maintaining a need to have an access further from the intersection with Highway 10. The uniqueness of the parcel is not a consequence of the petitioner’s own inaction or action. 5. The variance, if granted, will not alter the essential character of the locality. Natural elevations are used to minimize any impact to the land. The property has had two driveways for quite some time; the combined width of the two driveways is nearly the same. The encroachment within the required setback from the Elk River will not be observed by the general public and is buffered from view along the shoreline.
