07-24-1915 VCM VILLAGE OF ELK RIVER COUNCIL MEETING July 24, 1915 A Special meeting of Village Council was held at the office of C.F. Fiman on Saturday July 24, 1915. Present – C.F. Fiman, Pres, E.E. Scott and F.M. Plank Trustees and W.F. Chadbourne Clerk The first object of this meeting was to dispose of the matter of vacating Cedar Street in Village of Orono or upper town. On motion duly made seconded and carried the following resolution was unanimously carried. Resolution Whereas there was heretofore presented to the Council the petition of F.D. Waterman, et al, the owners of all the land and property abutting upon and adjoining the street hereinafter described, praying for the vacation of that part of Cedar Street described as follows All that part of Cedar Street as shown on the original plat or map of Orono lying north and westerly of a straight line drawn from the southeasterly corner of lot 5 in Block 5 of the town plat of Orono as the same appears of record in the office of the Register of Deeds in and for Sherburne County, Minnesota to the southerly corner of Block (6) of Auditors Addition to Elk River according to the plat thereof of record in the office of the Register of Deeds aforesaid, which said petition is duly verified, as provided by law, and sets forth the facts and reasons for said vacation, and whereas, said council deemed it expedient that the matter therein referred to should be proceeded with, and ordered said petition to be filed of record in the office of the village Clerk of said Village and ordered said Village Clerk to give published and posted notice in the manner and for the time required by law that said Petition and the subject matter thereof would be heard and considered by th the Council at a meeting to be held in the Bank of Elk River in said Village on the 24 day of July 1915 at 8 o’clock P.M. which said notice was duly published and given, and Whereas, said Council did meet at the said last named time and place above named and appointed therefor, and did then and there hear all testimony and evidence addressed on the part of said petitions, and all other persons interested in the matter of said proposed vacation and did take proof of the matter in said petition, and being of the opinion that the prayer of said petition should be granted, and it appearing for the interest of the public so to do Now therefore, it is hereby Resolved by the council of the Village of Elk River, Minnesota that All that part of Cedar Street as shown on the original plat or map of Orono lying north and westerly of a straight line drawn from the southeasterly corner of Lot 5 in Block 5 of the town plat of Orono as the same appears of record in the office of the Register of Deeds in and for Sherburne County Minnesota, to the southerly corner of Block (6) of Auditors Addition in the office of the Register of Deeds aforesaid be and shall hereby is vacated and discontinued as a public street. Scott and duly declared carried. The President appointed a committee of two consisting of F.M. Plank Trustee and E.E. Scott Trustee to assist Road overseer J.E. Hamlet in looking after the covering of Main Street. Village Clerk was duly authorized to issue a permit to C.E. Falk Hardware Co to rebuild store building burned June 28, 1915 according to plans and specifications, same as building burned which plans were duly filed and accepted at this time of building No. 1 also to occupy ½ of Main Street in front of said building during operation of building No other business appearing adjourned W.F.
