Background/Discussion
The city adopts user fees to fund services provided or required due to the request or action of an individual or
entity. A fee for service ensures the individual/entity bears most, if not all, of the cost incurred by the city to
provide that service. These user and regulatory fees are set according to the estimated reasonable cost of service,
including direct and indirect costs.
When a fee does not fully cover the cost for service another city revenue source subsidizes that cost and in most
cases it’s the General Fund. The City Council reviews and updates user fees on an annual basis to help reduce
the need for a General Fund subsidy, which are paid for with tax-payer dollars.
Adjustments to the fee schedule are highlighted in red and reflect the need to recover things such as increased
regulatory costs, staff time, indirect costs, or development related impacts on city services. More explanation is
noted directly on the fee schedule for some of the items. Some fees have been deleted as they are obsolete, the
material is online, or data practices policy applies. Adjustments to the following existing fees are shown in the

Who Should Pay Fees?
Council can set fees to fully recover the cost of a service or set a lower fee to provide a certain level of
subsidy, or alternatively, reduce costs by reducing the level of service.
Some programs and services may justify a subsidy from a tax based or alternative revenue source. For
example, community supported public services based on social, safety, or general community welfare.
Services supporting the general public, such as public safety, are supported by tax and other non-fee
revenues, while services more elective in nature and of specific benefit to individuals are typically
supported by charging fees to the user.
Within the services typically funded by user fees, there are several reasons a Council may not advocate for
full cost recovery of services. The following factors are some key policy considerations when setting fees
at less than 100 percent of cost recovery:
Encouragement of desired behaviors. Keeping fees for certain services below full cost recovery
may provide better compliance from the community. For example, if the cost of a permit for a
residential tree removal is higher than the cost of the actual removal of the tree, many citizens will
avoid getting the permit.
Effect on demand for a particular service. Sometimes raising the “price” charged for services
might reduce the number of participants in a program. This is largely the case in recreation programs
such as camps or enrichment classes, where participants often compare the city’s fees to surrounding
jurisdictions or other options for leisure activities.
Benefit received by user of the service and the community at large is mutual. Many services
that directly benefit a group or individual equally benefit the community as a whole. Examples
include recreation programs, planning design review, historical dedications, and certain types of
special events.

An Ordinance Amending the City Code to Establish a 2024 Master Fee Schedule
for the City of Elk River, Minnesota
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1.
The schedule of fees and rates attached hereto as Exhibit A, Exhibit B, and Exhibit C is hereby
adopted by deleting the strikethrough language and adding the underline language.
SECTION 2.
Where a direct conflict exists between the amount of a fee or charge set by any provision of the City
Code and a fee or charge set by this Ordinance, the fee or charge set by this Ordinance applies.
SECTION 3. That this ordinance shall become effective January 2, 2024.

A Resolution of the City of Elk River Approving Notice of Summary Publication of
Ordinance #24-01 an Ordinance Adopting the 2024 Master Fee Schedule
WHEREAS, on January 2, 2024 the Elk River City Council adopted Ordinance 24-01 approving
the 2024 Master Fee Schedule; and
WHEREAS, the enactment of this ordinance establishes fees and charges required by the City
Code and to comply with Minnesota Statutes 462.353, sub.4; and
WHEREAS, the 2024 Master Fee Schedule lists fees and charges for Administrative, Financial,
Environmental, Planning, Development, Building, Parks and Recreation, Fire, Police, and Elk River
Municipal Utility services along with code enforcement violations; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the
Office of the City Clerk, City of Elk River, 13065 Orono Parkway, during regular business hours –
8:00 a.m. to 4:30 p.m., Monday through Friday; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: by at least four-fifths vote, authorizes the publication of the title and
summary of Ordinance 24-01 and that Ordinance 24-01 shall become effective January 2, 2024.
