Consider a request by Ronald Dargis to vacate a portion of right-of-way of York Street.
Location
The proposed easement vacation is located on the north side of Main Street, on the east side
of 1946 Main Street.

Overview
The applicant is requesting that the City vacate a portion of the right-of-way of York Street.
The right-of-way extends from Main Street north to Lake Orono. The right-of-way is about
60 feet wide, was originally platted as part of the Town of Orono plat and has been utilized
by the applicant as yard and their driveway to Main Street.
The right-of~way could be used to provide public access to Lake Orono. This currently
underutilized resource could be developed as an easily accessible point to access Lake

Orono. The planning staff recommends denial of the request to vacate a portion of York
Street.
The Parks and Recreation Director's recommendation is to deny the request to vacate a
portion of York Street that abuts Lake Orono. There is a similar street access to shoreline on
the north side of Lake Orono that is used as a neighborhood canoe launch and kids fishing
spot. This location on the south side of Lake Orono could function in the same way. Staff
believes that public access to waterfront is a premium resource, which should be preserved.

Recommendation
Staff recommends that the City Council deny the request to vacate a portion of York Street
north of Main Street to Lake Orono.

RE: YORK STREET VACATION REQUEST
Dear Mr. Harlicker:
I have reviewed the York Street vacation request submitted by Ronald and Paula Dargis.
The request is to vacate York Street from Main Street to Lake Orono. There is a publicly
dedicated right-of-way in this area from one of the old plats of the original City. Although
this is a platted right-of-way, it has been approximately 20 years that it has not actually been
a drivable road to the lake. The old street surface was removed and lawn was established
next to Mr. and Mrs. Dargis' home. I have checked with Fire Chief Bruce West and there is
no Fire Department need to ever utilize this public right-of-way to get to Lake Orono. I
would guess that most people would think that there is no public right-of-way, since it has
been established as a lawn for so many years. Given this, I see no reason not to vacate the
public right-of-way and establish it as private property for which it has been used for many
years.
