Action Requested
Adopt, byT motion, an ordinance amending the following sections pertaining to signage:
1. Section 30-860 PeYmit
2. Section 30-879 Residential Districts.
Background/Discussion
Sign Permits (Sec. 30-860) - To improve the wall sign permit application process staff recommends updating the
ordinance to on1yT require one permit for all `vall signage on a single structure. CurrentlyT, a permit is required for
each `vall sign, which is cumbersome on our ne`v online permit software. Freestanding signage `vill continue to
require one permit per sign as each sign is site and context specific.
Apartments (Sec. 30-879) - A review of an apartment sign permit found that sign Yequirements for apartments
outside of Planned Unit Developments are not clearly codified. Staff recommends following the C1 zoning
district standards foY freestanding signs as the district closelyr reflects a non-residential use in a neighborhood.
Staff also Yecommends limiting wall signage to 32 squaYe feet.
The ordinance does allo`v nonresidential uses, such as churches, syTnagogues, and schools, in residentially zoned
districts, one freestanding sign or one `vall sign, not to exceed 96 sf of combined sign area. Staff believes this too
limiting for a multi-famil�T housing development.
Planning Commission
No one spoke at the public hearing and no comments were received since the meeting. The Planning Commission
had no questions or concerns and unanimouslyT recommended approval.

An Ordinance Amending Section, 30-860, Permit, of the City of Elk River,
Minnesota, City Code
The City Council of the CityT of Elk River does hereb�T ordain as follows:
SECTION 1. That � 30-860, Permit, of the CityT of Elk River Code of Ordinances shall be amended
to read as follo�vs:

�1) The mau�tenance of a si�n or chan�u�g the co��- «�ithout an increase in area.
{�}(2) On-premises construction signs that compl�T `vith subsection 30-867(b).
{�}i3i On-premises signs, including but not limited to directional signs,
informational signs, private sale signs and nameplates, having a sign area of four
square feet or less.
{�}(4) Portable signs in the do`vnto�vn district.
{�}(5� Political signs.
{�}(6) On-premises residential or commercial real estate signs that comply with
subsection 30-867(c).
{�}(c) Application. Application foY a permit for the erection, structural alteration, or
relocation of � signs shall be made to the cit�T administrator, or designee, upon a form
provided byT the cityT and shall include the following information:
(1) The name and address of the owner of the sign.
(2) The street address or location of the propernT on which the sign is to be located,
along with the name and addYess of the pYopeYty owner.
(3) The tyTpe of sign or sign structure as defined in this chapter.

(4) A site plan showing the proposed location of the sign along with the locations and
square footage areas of all existing signs on the same premises.
(5) Structural details as required.
(6) The building official, at their discretion, mayT require plans prepared byT a structural
engineer to verifyT structural and wind load requirements.
{t} ci li Fee. All applications for permits filed with the cit�T administrator, or designee, shall be
accompanied byT a payTment of the initial permit fee for each sign in such amount as
determined byT cityT ordinance.
{�}(e) Issuance oT� denial. The city admitustratoY, oY designee, shall issue a peYmit foY the
eYection, alteYation, change of copyr oY Yelocation of�r signs witl�in 30 da�rs of Yeceipt of the
completed application and applicable fees, provided that the sign complies `vith all applicable
laws and regulations of the cit�T. In all applications, where a matter of interpretation arises,
the more specific definition or higher standard shall prevail. When a permit is denied byT the
cityT administrator, or designee, written notice shall be provided to the applicant along with a
brief statement of the reasons for denial. The city admitustrator, oY designee, mayr suspend oY
revoke an issued peYmit foY any false statement oY misYepYesentation of fact in the
application.
{�-}(fii FailuTe to ol�tain pe��nit.. If any sign is installed oY placed on any propertyr prior to
receipt of a peYmit, the specified permit fee shall be doubled. HoweveY, payrment of the
doubled fee shall not relieve anyT person of anyT other requirement or penalties prescribed in
this ordinance.
SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by
law.

The City Council of the CityT of Elk River does hereb�T ordain as follows:
SECTION 1. That � 30-879, Residential districts, of the CityT of Elk River Code of Ordinances shall
be amended to add the followin�ara�ra�h�-��a �� �"�--��:
