A Resolution of the City of Elk River Approving Notice of Summary
Publication of Ordinance #24-05 An Ordinance Amending the Review
Procedures for Planned Unit Developments
WHEREAS, on January 16, 2024, the Elk River City Council adopted Ordinance 24-05
amending Section 30-1564, of the Elk River Code of Ordinances; and
WHEREAS, the proposed ordinance amendment changes the review procedures for a
proposed Planned Unit Development (PUD) from a Conditional Use Permit to an
Ordinance Amendment; and
WHEREAS, the change will improve the public's understanding of the development rights
within a PUD by documenting the standards within the city's code of ordinances; and
WHEREAS, a copy of the full text of the ordinance is available for inspection by any
person at the office of the Elk River City Clerk, 13065 Orono Parkway, during regular
business hours; and
NOW, THEREFORE, BE IT RESOLVED by the City Council, by at least four -fifths
vote, authorizes the publication of the title and summary of Ordinance 24-05.
The motion for adoption of the foregoing resolution was duly seconded by Councilmember
Westgaard, and upon vote being taken thereon, the following voted in favor thereof: Mayor
Dietz, Councilrnembers Beyer, Grupa. Wagner and West;:Eard and the following against:
None, whereupon said resolution was declared duly passed and adopted.
The following members were present: Mayor Dietz, Councilmembers Bever, Grupa. Wagner
and Westgaard and the following absent: None
