Supporting Documentation from Applicant Overview The applicant, on behalf of Cingular Wireless, is proposing to rezone an area of 100' X 100' to Antenna Overlay and a conditional use permit for a 199' tall antenna tower. The area is part of a larger 23 acre parcel, which is part of a 220 acre family farm. The surrounding property is zoned A1 and Mining Overlay. The surrout1ding land uses include agricultural, mining and the landfill. The wind generator is located just north of this site on 22Sth Avenue. Rezoning In order to construct the proposed tower, a rezoning to AT is required. This overlay district was established to manage the placement of antenna towers and to ensure their proper placement regarding health, safety and welfare of the community. The overlay district does not change the underlying A 1 zoning district, all the uses allowed in the A 1 district will continued to be allowed on land zoned AT. In considering a rezoning request of this nature, consideration should be given to the compatibility with surrounding land uses and whether the rezoning is necessary to provide effective wireless telecommunication coverage for the city. The proposed rezoning is compatible with the surrounding land uses. The applicant has shown that this site is necessary to provide effective wireless coverage for the city. The rezoning is also consistent with the Comprehensive Plan for the city. Conditional Use Permit Co-location Requirements The applicant has looked at co-locating on other sites within the city. They found that there are no acceptable co-location opportunities within one mile of the proposed site. At a height of 199 feet, the tower will provide the opportunity for 4 additional carriers. Construction Requirements The applicant will comply with the construction requirements outlined in the ordinance. Design Standards The proposed to~er will be a mono-pole with a flat gray galvanized steel finish which will blend in with the sky. The communication equipment at the base of the tower will be located in a small shelter. The tower and equipment will be enclosed with a 6 foot high chain link fence topped with 3 strands of barbed wire. Access will be provided from 22Sth Avenue by a 12 foot wide gravel drive. The tower complies with setback requirements. Sigps and Advertising No signage or advertising are proposed. Illumination No lighting is proposed. A safety beacon will be located on top of the tower. Standards for Issuance of a Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, i,!jure or detrimentallY qffect the use and e,!jqyment of other properry in the immediate viciniry or the public health, scifery, morals, comfort, convenience or general we(fare of the neighborhood or the ciry. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderlY development and improvement of surrounding vacant properry. 4. Will be seroed adequatelY !?J and will not adverselY qffect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer rystems, parks and schools; and wzll not, in particular, create trcif.fic congestion or interference with trcif.fic on aqjacent and neighboring public thoroughfares. 5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to a'!)l persons or properry because of excessive trcif.fic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor importance. 7. Will fullY complY with all other requirements of this Code, including a'!)l applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the ciry. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. Recommendation Rezoning Staff recommends that the Planning Commission recommend approval of the proposed rezoning request to AT based on the following findings: 1. NARRATIVE OVERVIEW American Tower Corporation seeks a Conditional Use Permit and any other necessary approvals to construct a Wireless Telecommunication Service Facility ("WTSF") at the location in exhibit "A" (the "Property"). American Tower and/or its lessees (Cingular Wireless) have acquired licenses from the Federal Communications Commission ("FCC") to provide Personal Communications Services ("PCS") coverage throughout the United States. These licenses include the Elk River, Minnesota area and the remainder of the greater Minneapolis Trade Area. This regional system is operating under the name of Cingular Wireless and is part of an integrated nationwide network. of coverage. The Wireless Telecommunications Service Facilities ("WTSF"), which Cingular proposes to utilize on the property, is necessary in order to provide uninterrupted PCS services to your community, including services such as wireless telephone service, voice paging and wireless data transmission. Cingular's pes technology operates atvar1.ous radio frequency ("RF") bands, specifically referred to as the ''E'' bandwith between 1885 and 1890, and 1965 and 1970 megahertz and utilizes a digital wireless voice and data transmission system. This technology promises to provide consumers with enhanced service (mcluding greater sound clarity and privacy) as well as new services not currently available under some traditional analog cellular systems. Like traditional cellular phone systems, PCS operates on a "grid" system, whereby overlapping "cells" mesh to form a seamless wireless network. The technical criteria for establishing cell sites are very exacting as to both the height and location of the WTSF. Within the Elk: River area, cell sites are generally located approximately seven (7) to ten (10) miles apart. Based on a computerized engineering study which takes into account among other things, local population density, traffic patterns and topography, Cingular's engineers . have identified the need for a PCS site in the Elk River area. The site along Hwy 169 and south of 225th Ave. is within the geographic area in which a facility must be located in order for it to function as an integral part of the PCS network. The property was sdected based on its satisfying Cingular RF criteria (including antenna height) and American Tower Corporation and Cingular's review of local land uses and site availability. Specifically, proximity to the Hutchinson residential and business communities and major roadways were rdevant siting criteria. The property is zoned Agricultural. Pursuant to the City of Elk River Zoning Ordinance, American Tower Corporation, in conjunction with it's lessee, Cingular Wirdess his made application for a Conditional Use Permit in order to erect and maintain a wirdess PCS facility, including installing a multi-carner 199 foot monopole tower with antennas at . the specified antenna center line, or "ACL", noted on supplied site specific construction drawings submitted for review. American Tower Corporation's tower site and Cingular's facility will be contained within the 100 foot by 100 foot leased parcel, which will be surrounded by a six-foot (6') fence, with three (3) strands of barb-wire on top. The proposed facility is not staffed, and, upon completion, will require only infrequent site visits (approximately one time a month). Access will be provided to the WTSF via the proposed entry ways to the property leading off from the south side of 225th Ave. to the proposed site. Hence the facility will not have any material impact on either traffic. The site is entirdy self-monitored and connects directly to a central office where sophisticated computers alert personnd to equipment malfunction or breach of security. Moreover, no nuisances will be generated by the p,roposed PCS facility. In general, PCS technology does not interfere with any other forms of communications. To the contrary, .
