90-051 ORD e ORDINANCE 90 - 51 AN ORDINANCE ADOPTING THE 1988 MINNESOTA STATE BUILDING CODE; AND AMENDING SECTION 1000.00 OF THE ELK RIVER CITY CODE OF ORDINANCES The City Council of the City of Elk River ordains as follows: pection 1. That Section 1000.00 of the City of Elk River Code of Ordinances Titled "Adoption of State Building Code" be amended to read as follows: a. Minnesota Rules, Part 7510.3100 - 7510 3280 - Adoption of the 1988 Uniform Fire Code by Reference and are incorporated herein by this reference as if fully set forth, three (3) copies of which are on file in the office of the City Administrator. e B. Orqanization and Enforcement. The organization of the Building Department and Enforcement of the Building Code shall be as established by Chapter 2 of the Uniform Building Code, 1988 Edition. The Building Code shall be enforced within the incorporated limits of the City and extraterritorial limits two miles distant from any point on the City limits as authorized by Minnesota Statutes, 16B.62, Subd. 1. The Building and Zoning Department shall be the Building, Code Department of the City of Elk River. The Administrative Authority shall be a State Certified "Building Official." The City Council shall designate the Building Official for the City of Elk River. C. Permits, Inspections, Fees and Surcharqe. -- 1. Permits, Inspections and Fees. Permits, inspections and collection of fees shall be as provided in Chapter 3 of the Uniform Building Code, 1988 Edition. The Council shall establish the fees and charges from time to time by resolution. 2. Surcharqe. In addition to the required permit fee, the applicant shall pay a surcharge to be remitted to the Minnesota Department of Administrator as prescribed by Minnesota Statutes 1984, Section 16B.70. . e e D. Violations and Penalties. The violations of this section shall be a misdemeanor. Each day that a condition in violation of this section shall continue shall constitute a separate offense. Section 2. This ordinance shall take effect and be in full force from and after the date of its publication.
