SR 02-06-2006 City of Elk River REQUEST FOR COUNCIL ACTION Agenda Section Meeting Date Consent Februa 6,2006 Item Description Adopt a Resolution to Approve a Premises Permit for Communi Charities of MN Item Number 3.6 Prepared by oan Schmidt Reviewed by Introduction The Community Charities of MN has requested to renew its premises permit to conduct charitable gambling at the Elk River Bowl. The permit will run for two years from April 1, 2006 until March 31, 2008. Discussion The City's ordinance requires that 75% of the lawful purpose expenditures must be spent within the City's trade area. The trade area for Elk River includes the cities of Elk River, Ramsey, Otsego, Rogers, and Zimmerman. The attached chart shows that the amount of expenditures spent in the trade area during the years 2004 and 2005 exceeded the required 75%. Financial Impact If the Community Charities of MN are not allowed a Premises Permit, the trade area would not receive 75% of the lawful purpose expenditures. Attachments . Resolution . Council Action Motion by _ Second by _ Vote Follow Up RESOLUTION 06- A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPROVING PREMISES PERMIT FOR THE COMMUNITY CHARITIES OF MN WHEREAS, Community Charities has made application to the State Gambling Control Board for a Premises Permit Renewal; and WHEREAS, the Premises Permit will allow charitable gambling on the premises of the Elk River Bowl located at 13161 Highway 10 in the City of Elk River for the period of April 1, 2006 to March 31, 2008; and WHEREAS, Community Charities has met the city's requirement of spending 75 percent of its lawful expenditures within the city's trade area during the past two years; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that a Premises Permit be granted to the Community Charities to allow charitable gambling operations at the Elk River Bowl located at 13161 Highway 10 in the City of Elk River, Minnesota. Passed and adopted this 6th day of February 2006.
