Introduction
The Fraternal Order of Eagles Aerie #3264 has requested to renew its premises permit to conduct
charitable gambling at the Eagles Club. The permit will run for two years from June 1,2006 until May 31,
2008.
Discussion
The City's ordinance requires that 75% of the lawful purpose expenditures must be spent within the
City's trade area. The trade area for Elk River includes the cities of Elk River, Ramsey, Otsego, Rogers,
and Zimmerman. The attached chart shows that the amount of expenditures spent in the trade area
during the years 2004 and 2005 exceeded the required 75%.

If the Eagles are not allowed a Premises Permit, the trade area would not receive 75% of the lawful
purpose expenditures.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPROVING PREMISES PERMIT FOR THE FRATERNAL ORDER OF
EAGLES AERIE #3264
WHEREAS,
The Fraternal Order of Eagles Aerie #3264 has made application to the State
Gambling Control Board for a Premises Permit Renewal; and
WHEREAS,
the Premises Permit will allow charitable gambling on the premises of the
Fraternal Order of Eagles Aerie #3264 located at 824 Railroad Drive in the City
of Elk River for the period of June 1, 2006 to May 31, 2008; and
WHEREAS,
The Fraternal Order of Eagles Aerie #3264 has met the city's requirement of
spending 75 percent of its lawful expenditures within the city's trade area during
the past two years; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota that a Premises Permit be granted to the Fraternal Order of Eagles Aerie #3264 to allow
charitable gambling operations at the Eagles Club located at 824 Railroad Drive in the City of Elk
River, Minnesota.
Passed and adopted this 6th day of February 2006.
